Supervision of notary activities in Vinh City
(Baonghean.vn) - On the afternoon of September 21, in Vinh City, the Supervisory Delegation of the Provincial People's Council's Legal Committee coordinated with the Department of Justice and a number of related departments and agencies to have a working session to supervise the operation of the Central Notary Office.

The Central Notary Office was established and started operating in 2010. Since its inception, the office has always had a firm grasp of legal documents related to the field of notarization and documents guiding implementation as well as documents related to the right to use and ownership of assets, combined with documents of the user related to personal identity and assets to ensure the rights and obligations of the parties in the contract transaction process. Since its inception, the office has not had any cases of errors or disputes in court or with other related parties.

During the monitoring process at the Office of the Monitoring Team, some shortcomings were noted, such as: currently, some wards and communes in Vinh city still certify documents on inheritance division. Therefore, the owners of the divided land still use this document for mortgage or sale transactions, so when a dispute occurs, the rights of the mortgagee or transferee are not guaranteed because the transaction document is beyond the authority.

In addition, there are still some problems from offices and one-stop centers in providing documents related to land ownership, especially certificates of land use rights and housing rights at all levels that are not specifically defined by the user, especially before 2009, so there have been some loopholes that cause difficulties in notarization work and cause disputes. There are still many people who conduct notarization transactions with expired ID cards, causing difficulties in notarization transactions.

Through the monitoring session, the Central Notary Office also recommended that relevant agencies build a database to manage and provide information on real estate transaction contracts. Competent authorities need to have a policy to guide the issuance of land use right certificates bearing the correct name of the user, to avoid inconvenience to people in civil contract transactions. It is also necessary to unify administrative legal procedures related to land transactions to reduce unnecessary administrative procedures.
