In what cases are teachers allowed to teach at home?
Circular 29 of the Ministry of Education and Training (MOET) regulating extra teaching and learning allows teachers to teach extra in many cases.
Private tutors must register their business and report to the principal.
Circular 29 stipulates that organizations or individuals organizing extra-curricular teaching and learning activities outside of school for money must comply withbusiness registrationand publicly disclose information on the electronic portal or post at the tutoring facility the following contents: tuition fees, subjects, duration, list of teachers, etc.
Teachers who are teaching in schools need to report to the principal.
Thus, home tutors who have registered their business, reported to the principal and listed tuition fees are considered legal tutors.

Teachers tutor their students at school for free.
Circular 29 stipulates: "Teachers currently teaching at schools are not allowed to teach extra classes outside of school for money from students that the teacher is assigned by the school to teach according to the school's educational plan."
Thus, teachers are not allowed to take their students out of class to teach for money. According to the Ministry of Education and Training, this regulation aims to ensure the rights of students and avoid teachers "pulling" students out of class to teach extra.
However, if a teacher tutors his students butfreeis not prohibited.
Art, sports, life skills teacher
Classes on arts, sports, and life skills are considered activities to foster talents, physical training, and life skills, so they are not subject to the regulation "prohibiting tutoring for primary school students". In other words, the subjects of these classes are not limited to grade levels.
However, teachers working at schools who want to open extra classes on arts, sports, and life skills still need to register their business and report to the principal according to regulations.
Teachers tutor students from junior high school and above
In cases where it is prohibited to organize extra classes, Circular 29 stipulates that it is prohibited to teach extra classes to primary school students. Therefore, it is only legal for teachers to teach extra classes to students at secondary school level or higher.
However, teachers of art, physical education, and life skills training are allowed to teach additional classes to primary school students to foster their artistic and physical education talents according to the provisions of law.
Can students tutor after February 14?
Circular 29 regulating extra teaching and learning, effective from February 14, applies to: extra teachers and extra learners; organizations and individuals organizing extra teaching and learning; and related organizations and individuals.
Thus, Circular 29 does not only regulate the tutoring activities of teachers. All organizations and individuals participating in tutoring and organizing tutoring are subject to this Circular. Tutoring is a tutoring activity, so student tutors will be considered tutors.
