Giving motorbike to underage child, causing fatal accident, father and son prosecuted
The Office of the Investigation Police Agency of Phu Tho Province Police announced that it has issued a decision to initiate criminal proceedings, prosecute the accused and issue a temporary detention order against Nguyen Minh Hieu, born on November 21, 2007, residing in Cay Xy village, Son Dong commune, Phu Tho province, for the crime of "Violating regulations on road traffic participation" as prescribed in Article 260 - Penal Code.
At the same time, the police agency also issued a decision to supplement the decision to prosecute the criminal case, prosecute the accused and issue a ban on leaving the place of residence against Nguyen Van Manh, born in 1979 (Hieu's father) for the crime of "Allowing an unqualified person to drive a vehicle to participate in road traffic", according to the provisions of Article 264 - Penal Code.

According to the investigation results, on the evening of July 9, Nguyen Minh Hieu borrowed a Honda Wave α motorbike (without a license plate) that Mr. Manh had just bought to go out and with Mr. Manh's consent.
After that, Hieu invited two more friends, Do Thanh Chung and Nguyen Quang Huy (both born in 2007), to go out to the lakeside area in Lap Thach commune. While there, Chung drove Huy on a motorbike, while Hieu drove a motorbike borrowed from his father alone.
On the way back, Hieu drove Huy, drove the motorbike at high speed, without wearing a helmet, and collided with Mr. Tran Van Toan (local resident) who was riding a bicycle in the same direction. The collision caused Mr. Toan to die on the spot.
After the accident, Hieu and Huy fell onto the road and were hit by a motorbike driven by Nguyen Duy Hoang Anh going in the opposite direction, causing Huy to also die and Hieu and Hoang Anh to be slightly injured.

The investigation determined that Hieu was underage, did not have a driver’s license, did not control his speed, and did not keep a safe distance, which were the direct causes of the accident. At the same time, the police also clarified the responsibility of Mr. Nguyen Van Manh - the person who gave the car to Hieu to drive even though he knew that his son did not meet the legal requirements. This behavior caused particularly serious consequences, leading to death, so Mr. Manh was prosecuted.
The incident is a warning bell for parents in managing their children, especially not to let unqualified people drive vehicles. Because this not only poses a risk of serious accidents, but can also lead to legal consequences for parents if they intentionally violate.
