Decree 168/2024/ND-CP (referred to as Decree 168) regulates administrative sanctions for violations in the field of road traffic, deduction of points, and restoration of driving license points, replacing Decree 100/2019/ND-CP (amended and supplemented by Decree 123/ND-CP), officially taking effect from January 1, 2025.

According to the newly issued Decree 168, the penalty for handing over a vehicle to an unqualified person has increased many times.

Specifically, a fine of 8 - 10 million VND will be imposed on individuals delivering motorbikes and mopeds; a fine of 16 - 20 million VND will be imposed on organizations delivering motorbikes and mopeds.

If a car is handed over to someone who is not qualified to drive it, the fine increases to 28 - 30 million VND for individuals and 56 - 60 million VND for organizations.

Thus, compared to the previous Decree 100/2019, which only imposed a fine of 800,000 - 2,000,000 VND, the current fine has increased dozens of times. This fine is considered to be a sufficient deterrent, limiting the behavior of parents giving their underage children the ability to drive.

The Law on Road Traffic Order and Safety 2024 stipulates that people driving motorbikes from 50cm3Must be 18 years of age or older and have a valid driver's license. For motorcycles under 50cm3, minimum age is 16.
