Comments on human rights regulations in amending the Constitution

On September 11, in Ho Chi Minh City, the Ho Chi Minh National Academy of Politics and Public Administration in coordination with the United Nations Development Program (UNDP) organized a scientific workshop "Contributing comments on regulations related to human rights and civil rights in the Draft Amendment to the 1992 Constitution."

The workshop was attended by nearly 100 delegates including scientists, lecturers from universities, research institutes and leaders of People's Councils of several southern provinces and cities.

Associate Professor, Doctor Le Quoc Ly - Deputy Director of the Ho Chi Minh National Academy of Politics and Public Administration, said: This workshop was organized to create an additional forum for exchange and dialogue between representatives of the Draft Constitutional Amendment Editorial Board and scientists, policy and legal experts, leaders, managers, socio-political organizations, and social organizations; on that basis, make recommendations to the Draft Constitutional Amendment Committee on contents related to regulations on human rights and civil rights in the Draft Constitutional Amendment 1992.

Professor, Doctor Tran Ngoc Duong, senior expert of the National Assembly, said that the draft amendment to the 1992 Constitution in Chapter II: Human rights, basic rights and obligations of citizens is compatible with the provisions of international treaties on human rights of which our country is a member.

However, the provision in Article 15 of the Draft: "Human rights and civil rights may only be restricted to the extent necessary in emergency situations for reasons of national defense, national security, public order, public health and morality" only stops at the principle level, but has not been specifically regulated for each right, how to restrict rights? Which rights are restricted, which rights are not restricted? There are absolute rights that are not restricted such as the right to life...

According to Professor, Doctor Tran Ngoc Duong, it is necessary to study and add restrictions to each right, so that implementation can both limit arbitrariness and make it convenient for people and citizens to exercise their rights.

At the workshop, many experts also mentioned Clause 1, Article 6 with the provision "Citizenship rights are inseparable from citizen obligations."

Scientists and experts also focused on exchanging and discussing human rights and civil rights issues such as regulations related to civil and political rights; regulations on socio-economic rights and rights of vulnerable groups; independent institutions, mechanisms for monitoring the implementation of human rights and civil rights and some general principles and international experiences in the issue of human rights and civil rights./.
