Sending spam messages can be fined up to 50 million VND
The Government has just issued a Decree regulating administrative sanctions for violations in the telecommunications sector, including a fine of 30-50 million VND for sending and distributing spam messages.
Stipulating heavy penalties for violations, the Decree clearly states that a fine of 10 - 20 million VND will be imposed for the act of illegally disclosing private information of telecommunications service users.
For acts of illegally buying, selling or exchanging private information of telecommunications service users, the fine is from 30 to 50 million VND.
The Decree also stipulates a fine of 20-30 million VND for acts of stealing or eavesdropping on information on telecommunications networks; stealing and illegally using passwords, encryption keys, and private information of organizations and individuals; and illegally preventing access to information of organizations and individuals.
For one of the following acts: Taking advantage of telecommunications activities to incite violence, obscenity, depravity, crime, social evils, superstition; sending and distributing spam messages; providing services with content of fortune telling, superstition; information with content of gambling, lottery or to serve gambling, lottery will be fined from 30-50 million VND.
Damage to fiber optic cable lines is subject to a fine of 50-70 million VND.
Fines from 10 to 20 million VND for illegal access to public telecommunications networks, private telecommunications networks, specialized telecommunications networks or other telecommunications subscriber lines.
The Decree also clearly stipulates that acts of damaging optical cables, antennas or equipment of transmission systems, switches and other telecommunications equipment of the national telecommunications backbone system shall be subject to a fine of 50-70 million VND.
In particular, the highest fine of up to VND100 million applies to acts such as: not fulfilling investment commitments; making contributions to the Vietnam Public Telecommunications Service Fund in violation of regulations; cross-subsidizing telecommunications services when determining rates.
