The Inspectorate of the Ministry of Home Affairs recommended that the Ministry of Industry and Trade consider handling the responsibilities of related organizations and individuals and cancel the results of the 2013 civil servant recruitment organized by the Market Management Department.

Inappropriate degree still accepted

According to the inspection conclusion, from August 2011 to August 2014, the Ministry of Industry and Trade and its affiliated units organized 16 civil servant recruitment exams. However, the Ministry of Industry and Trade's instructions on how to determine the successful candidates in 3 exams had content that was not in accordance with regulations. There were 2 exams that stipulated the conditions for admission regarding the type of training that was not in accordance with regulations. The civil servant recruitment councils of 7 exams did not ensure the quantity and composition.

The time of establishing the Recruitment Council of 5 exams was not in accordance with regulations and up to 7 exams did not establish an Exam Supervision Board. According to the inspection conclusion, up to 6 exams were not publicly announced for recruitment and recruitment announcements for 11 exams were incomplete. In particular, there were cases where the professional qualifications were not suitable for the recruitment position but candidates were still allowed to take the exam and pass.

There were also many violations in the marking process. Typically, up to 5 exams failed to provide some records during the marking process; 2 exams did not organize the marking at the designated location; the marking sheets in some exams did not show that each exam was marked by 2 independent members... The inspection team also concluded that the summation of scores for some exams was "inaccurate".

In addition, in 2013, although the Chairman of the Examination Council of the Ministry of Industry and Trade did not establish an Examination Review Board, he still organized the examination review in violation of regulations. The inspection conclusion clearly stated: The 2011 civil service examination organized by the Competition Management Department did not make a list and did not publicly announce the examination results and expected successful candidates.

In particular, in the 2013 exam organized by the Market Management Department, the inspection team discovered many violations such as the secrecy of exam questions and answers was not properly implemented. When publicly announcing the exam results, there was no prediction of the successful candidates, which was against the regulations. When there were complaints and denunciations, they were not promptly considered and resolved, leading to the deadline being exceeded.

Even the Ministry of Industry and Trade’s acceptance of special cases in recruitment was concluded by the Ministry of Home Affairs Inspectorate to have many violations. Specifically, through inspection, 21 cases were discovered where the Ministry of Industry and Trade recruited without obtaining the consensus of the Ministry of Home Affairs. While according to regulations, the Ministry of Industry and Trade must obtain the consensus of the Ministry of Home Affairs before accepting.

Clarify the responsibility of organizations and individuals who commit violations

Faced with a series of violations in the civil service recruitment examination at the Ministry of Industry and Trade, the Inspectorate of the Ministry of Home Affairs recommended that Minister of Industry and Trade Vu Huy Hoang consider and not recognize the results of the 2013 civil service recruitment examination organized by the Market Management Department. At the same time, establish a Council to inspect and evaluate the conditions, standards and results of performing assigned duties and tasks for civil servants recruited through examinations with improper examination forms. Proceed with the revocation according to authority and direct the revocation of recruitment decisions for those who do not meet the conditions and standards and notify the results to the Ministry of Home Affairs in March 2015.

The Inspectorate of the Ministry of Home Affairs also requested Minister Vu Huy Hoang to organize a review and clarify the responsibilities of organizations and individuals for the violations that have been concluded. Based on the nature and level of the violation, there will be a form of handling in accordance with legal regulations.

The Inspectorate of the Ministry of Home Affairs also proposed that the Minister of Home Affairs study and submit to competent authorities for consideration of innovating the method of recruiting civil servants and public employees. In the immediate future, it is recommended that the Government and the Prime Minister allow the application of information technology in civil servant recruitment exams in all ministries, branches and 5 centrally-run cities. Develop and submit to the Government regulations on sanctions for violations of regulations on recruiting civil servants and public employees.
