Speaking at the conference to solicit opinions from intellectuals, lawyers, representatives of ethnic minorities, and religious dignitaries on the draft amendments to the 1992 Constitution, organized by the Central Committee of the Vietnam Fatherland Front on March 27, President Truong Tan Sang said that the issuance of Directives and Resolutions in recent times shows that the Party and the National Assembly have set clear guidelines. The remaining issue is how to organize it in a practical way, and the important thing is that the new Constitution must reflect the aspirations of the entire Party and people.
The President acknowledged that the Central Committee of the Vietnam Fatherland Front had received about 8 million comments in various forms of organization and gathering, emphasizing that this is a valuable asset that must be collected, synthesized and transmitted objectively and completely to the Constitutional Amendment Drafting Committee and the National Assembly.
The President welcomed the presence of representatives of intellectuals, jurists, representatives of ethnic minorities, and religious dignitaries at the conference, which is of great significance. The President highly appreciated the enthusiastic, concise, and profound contributions, contributing to the successful implementation of the Politburo's Directive and the National Assembly's Resolution on collecting public opinions on the draft amendments to the 1992 Constitution.
The President said that the collection of opinions on the draft amendments to the 1992 Constitution will continue until September this year. The Presidium of the Central Committee of the Vietnam Fatherland Front and the Office of the President need to make more efforts in organizing the collection of people's opinions and proactively coordinate with relevant agencies so that the country can have a new Constitution that affirms an important political and legal basis for the integration and development process.
At the Conference, Vice President and General Secretary of the Central Committee of the Vietnam Fatherland Front Vu Trong Kim reported briefly on the implementation of collecting public opinions on the draft amendments to the 1992 Constitution. He emphasized the importance of this political activity which has great significance for the entire Party, the entire people and the entire political system.
Mr. Vu Trong Kim affirmed that the organization of public opinion collection on the draft amendments to the Constitution in the past time has attracted a large number of people from all walks of life; mobilized the intelligence, enthusiasm and consensus of the people, demonstrating the high responsibility of each individual and organization for amending and implementing the Constitution. At this conference, the Central Committee of the Vietnam Fatherland Front hopes to continue to receive more contributions from delegates.
Continuing to contribute ideas to the contents of the draft amendments to the 1992 Constitution, delegates of dignitaries, intellectuals, representatives of ethnic minorities, and religious dignitaries analyzed the practical situation and made specific recommendations.
Mr. Pham Xuan Hang, former Vice Chairman of the Central Committee of the Vietnam Fatherland Front, affirmed that building a more democratic Constitution is the basis for perfecting the socialist rule of law state of the people, by the people and for the people. Referring to the leadership role of the Communist Party of Vietnam, Mr. Hang emphasized that over the past 80 years, the country's victories are inseparable from the leadership of the Party. Therefore, the leadership role of the Party over the State and society is a historical necessity, so it must be constitutionally stipulated.
In response to the need to perfect the socialist rule of law state of the people, by the people, and for the people, institutionalizing the Party's leadership role is an urgent and inevitable need. The current position and strength of the country are the conditions for the Party to demonstrate its intelligence, affirm its mettle and responsibility, closely connect with the people, and serve the people with its constitutional responsibilities.
The role and position of the Vietnam Fatherland Front in the political system, performing the task of social supervision and criticism is the content that delegates focused on contributing their opinions with the desire to affirm and demonstrate more clearly the idea of promoting the strength of great national unity. Some opinions said that the content in Article 9 of the Draft has not conveyed the role of social criticism of the Fatherland Front; the provision "mobilizing people to exercise the right to supervision" makes the Fatherland Front "stand outside" and is not the subject of exercising people's sovereignty.
Delegate Nguyen Thi Le, former member of the Legal Advisory Council of the Central Committee of the Vietnam Fatherland Front, emphasized that amending the Constitution must truly meet the aspirations of the people. As someone who has worked for many years in the judiciary, she believes that the regulations for the police, courts, and prosecution sectors are extremely important. Referring to the trial principles of the Court, Ms. Le suggested that it is necessary to affirm the role of the Jury in the court, and stipulate that "when trying a trial, the Jury has equal rights with the judge" to ensure the rights of the person being tried.
Commenting on Article 5 of the Draft Constitution, Mr. Lu Van Que, member of the Presidium of the Central Committee of the Vietnam Fatherland Front, said that ethnic people attach great importance to and wish that the amended Constitution clearly defines and stipulates the strategic position of ethnic issues and ethnic solidarity; the rights and obligations of ethnic groups; the principles and policies for resolving ethnic issues; and the State's responsibility in promoting the internal strength of ethnic groups.
The Venerable Thich Duc Thien, the Venerable Mai Thanh, said that Article 25 of the draft, which states that citizens have the right to freedom of belief, is adequate; he expressed hope that the new Constitution will give the people the right to decide on important, national, contemporary, and long-term issues.
Welcoming the extension of time to facilitate the collection of public opinions, delegates also hoped that the draft Constitution should add provisions so that overseas Vietnamese can participate in promoting their right to mastery, participate in elections, and contribute their enthusiasm and resources to building the country./.
