Support job creation for workers whose agricultural land has been recovered

The Prime Minister has just signed Decision52/2012/QD-TTgon policies to support employment and vocational training for workers whose agricultural land has been recovered.

Accordingly, the subjects of application are laborers of households directly engaged in agricultural production whose agricultural land has been recovered by the State without land for compensation, who meet 3 conditions: 1- Have permanent residence registration at the household whose agricultural land has been recovered; 2- Are of working age; 3- Have the need to learn a trade, change jobs, find jobs, or borrow capital to create jobs.

Workers whose agricultural land is recovered according to the above regulations are entitled to support policies within 3 years from the date of the land recovery decision.

Vocational training support

Workers whose agricultural land is recovered and who need training and vocational training are admitted to vocational training facilities and supported with short-term vocational training costs (elementary level and vocational training under 3 months) are supported by the State with vocational training costs according to the provisions of Decision No.1956/QD-TTgThe Prime Minister approved the Project on vocational training for rural workers until 2020.

The State pays tuition fees for intermediate and college level vocational training courses. The tuition fees paid by the State are equal to the actual tuition fees of the training institution, but must not exceed the tuition fee ceiling for public intermediate and college vocational training institutions as prescribed by law.

Funding for vocational training at intermediate and college levels is allocated from the funding for vocational conversion support included in the training and vocational conversion plan and is included in the total budget of the investment project or the approved compensation and resettlement support plan.

For workers belonging to households whose agricultural land is recovered and who are also eligible for loans according to the provisions of the Decision157/2007/QD-TTgAccording to the Prime Minister's regulations on credit for students, students can borrow credit capital according to current regulations.

Support domestic job creation

Workers whose agricultural land is recovered and who need to find jobs are supported with vocational training counseling, job counseling, and free job referrals at the Job Referral Centers under the Department of Labor, War Invalids and Social Affairs of provinces and centrally run cities; priority is given to borrowing capital from the National Employment Fund according to the provisions of law.

Production and business establishments that employ many workers whose agricultural land has been recovered are entitled to preferential policies on land, credit, and taxes according to the provisions of law.

Support for working abroad under contract

Workers whose agricultural land is revoked and who want to work abroad will be supported with 100% of tuition fees for vocational training, foreign languages, and necessary knowledge training according to the provisions of the law on Vietnamese people working abroad under contracts; and 100% of the costs of health check-ups, passports, visas, and criminal records before going to work abroad according to the current regulations of the State.

In addition, daily meal allowance during the study period is supported according to the regulations in Decision No. 1956/QD-TTg; travel allowance for one-way trip from residence to study location for students living more than 15 km from the study location according to the regular fare of public transport at the time of payment.

This group of workers can also borrow capital at preferential interest rates from the Social Policy Bank to cover the necessary expenses for working abroad for a limited period. The maximum loan amount is equal to the total necessary expenses that the worker must contribute according to the regulations stated in the contract for each labor market. The loan interest rate is equal to the current loan interest rate for workers who are not from poor households working abroad for a limited period at the Social Policy Bank. The maximum loan term is equal to the time of working abroad according to the contract.

Workers in poor districts according to Resolution No.30a/2008/NQ-CPdated December 27, 2008 of the Government on the Program to support rapid and sustainable poverty reduction for 61 poor districts, when working abroad, they are entitled to policies according to the provisions of Decision No.71/2009/QD-TTgApril 29, 2009 of the Prime Minister approving the Project to support poor districts to promote labor export to contribute to sustainable poverty reduction in the period 2009 - 2020.

Workers are supported once for each content of support for working abroad under the contract as mentioned above.

Households and individuals whose agricultural land in residential areas, garden land, and ponds are not recognized as land under the provisions of Article 21 and the cases under the provisions of Clause 3, Clause 4 and Clause 5, Article 16 of Decree No.69/2009/ND-CPnot subject to Decision 52/2012/QD-TTg.
