Defendant Dao Quang Khanh was proposed to be prosecuted for the crime of "Violating corpses, graves, and remains" under Clause 2, Article 246 of the Penal Code and the crime of "Theft of property" under Clause 1, Article 138 of the Penal Code.
Previously, on April 14, the Hanoi People's Court opened a trial for the two defendants. During the public interrogation and questioning before the trial, a number of issues arose, especially the fact that the victim Huyen's body had not been found. Therefore, the Trial Panel requested clarification and stopped the trial, returning the case file to the Procuracy and the Hanoi City Police Investigation Agency for further investigation.
Recently, Hanoi City Police found a female body floating in the river at Van Duc ferry, Gia Lam district, Hanoi, suspected to be that of the victim Le Thi Thanh Huyen. The Institute of Criminal Science, Ministry of Public Security, analyzed and identified DNA from the bone sample of this body with the mucosal cell sample of the mother of the victim of the "Cat Tuong" case and hair samples of Le Thi Thanh Huyen's father and son. The identification results showed that the DNA of the floating body matched that of Le Thi Thanh Huyen's family.
After the investigation period, the police investigation agency has completed the additional investigation requests and continued to request the Procuracy to prosecute the defendants for the above crimes. Explaining the viewpoint of maintaining the original prosecution, Lawyer Nguyen Anh Thom - Hanoi Bar Association, who protects the rights and interests of defendant Dao Quang Khanh, said: "Up to now, there is no basis to determine the cause of death of Ms. Le Thi Thanh Huyen, the victim in the case."
