However, in addition to the achievements, the Law on Marriage and Family also has limitations. In particular, some provisions of the Law have not created an effective legal mechanism, not really consistent with the basic principles of civil relations - private relations; Some provisions of the Law have low feasibility, making the recognition and implementation of marriage and family rights still encounter many difficulties; Some marriage and family relations arising in practice have not been regulated by law or are not regulated specifically; Some provisions of the Law have not met the requirements of civil exchange practice and international integration of Vietnam.

In order to meet the objective requirements of the Vietnamese marriage and family practice, the revised Law on Marriage and Family will focus on 10 major contents, including many shortcomings and many issues arising in practice but not yet included in the 2000 Law on Marriage and Family such as: surrogacy, marriage age, same-sex marriage, divorce, marriage with foreign elements...

Speaking at the conference, Deputy Prime Minister Nguyen Xuan Phuc agreed with the draft report on objectives, viewpoints and some major orientations in the law-making process to amend and supplement a number of articles of the 2000 Law on Marriage and Family drafted by the Ministry of Justice. He also pointed out 5 orientations that need to be focused on for discussion. In particular, it is necessary to clearly identify the objectives and major viewpoints in the law-making process; It is necessary to review previous documents and selectively absorb the laws on marriage and family of other countries, especially those with progressive cultures and close to Vietnam; The settlement of relationships needs to be based on the characteristics of the law on marriage and family and other laws in the direction of respecting human rights; It is necessary to create a clear legal corridor, consistent with the customs and practices of all ethnic groups in Vietnam; The law-making process needs to start from the issue of respecting human rights and civil rights; Central and local ministries, branches and localities are requested to promote their responsibilities and closely coordinate with the Ministry of Justice to amend laws of the highest quality, meeting the country's development requirements and the most basic human rights.
