Guidance on the arrangement of cadres, civil servants and public employees in localities arranging administrative units at district and commune levels
(Baonghean.vn) - On November 30, 2023, the Central Organizing Committee issued Instruction No. 26-HD/BTCTW on the implementation of organization, cadres, civil servants, and public employees of Party agencies, the Vietnam Fatherland Front, and socio-political organizations in localities implementing the arrangement of administrative units at district and commune levels in the period 2023 - 2030.

Accordingly, the arrangement of organizations, cadres, civil servants, and public employees of Party agencies, the Fatherland Front, and socio-political organizations in localities implementing administrative unit (ADU) arrangement is carried out as follows:
Party organization arrangement
About the organization:
For newly established district- and commune-level administrative units due to the merger or consolidation of administrative units at the same level, the Standing Committee of the Party Committee at the next higher level shall directly develop a project and decide to establish a new Party Committee on the basis of merging or consolidating the Party organizations of the administrative units at the same level before the arrangement; appoint the executive committee, standing committee, secretary, and deputy secretary of the Party Committee according to the provisions of the Party Charter.
For district- and commune-level administrative units with adjusted boundaries, the Standing Committee of the provincial Party Committee shall lead and direct the implementation of the transfer of Party organizations; the immediate superior Party Committee where the Party cell or Party committee is located is responsible for carrying out the procedures for transferring the Party organization and transferring collective Party activities to Party members; the immediate superior Party Committee where the Party cell or Party committee is located is responsible for carrying out the procedures for receiving the Party organization and Party members corresponding to the adjusted boundaries.
For district and commune-level administrative units, the Party organization is dissolved according to the provisions of the Party Charter.
Regarding the number of Party Committee members, Standing Committee members, Deputy Party Committee Secretaries; the number of Party Committee members and Deputy Heads of the newly established Party Committee Inspection Committee:
For the first term of the new Party Committee, the maximum number of Party Committee members, Standing Committee members, and Inspection Committee members of the new Party Committee shall not exceed the total number of Party organizations at the same level before the arrangement minus the number of comrades who have retired, retired, or transferred to other jobs. The maximum number of Deputy Party Secretaries and Deputy Heads of the Inspection Committee of the new Party Committee shall not exceed the total number of Party leaders and deputies at the same level before the arrangement minus the number of comrades who have retired, retired, or transferred to other jobs.
The next term shall be carried out in accordance with the regulations and directives of the Politburo and the instructions of the Central Committee.
Arrange the Fatherland Front and socio-political organizations.
The Party Committee of the Vietnam Fatherland Front, the Party Committee of socio-political organizations at the Central level, and the Secretariat of the Central Youth Union, based on their organization's charter, shall lead, direct, and guide the organization of the leadership agency corresponding to the organization of the Party. In particular, note three issues: Developing a plan for organization arrangement, transfer, and staff consolidation; Procedures for establishing organizations, determining the first term, and calculating the order of the congress term of the Fatherland Front and socio-political organizations at the administrative unit after the arrangement; The number of committee members, standing committees, and vice chairmen of the Fatherland Front Committee and the number of executive committee members, standing committee members, and vice chairmen (deputy secretaries) of socio-political organizations in the first term at the administrative unit after the arrangement must not exceed the total number of organizations at the same level before the arrangement of the administrative unit; At the same time, encourage the reduction of the number of the above positions to soon comply with general regulations.
The Standing Committee of the provincial Party Committee leads and directs the Party Delegation of the Fatherland Front, the Party Delegation of socio-political organizations at the provincial level, and the Standing Committee of the provincial (municipal) Youth Union to guide the arrangement, transfer of organization and consolidation of cadres; determine the number of committee members, standing committee, vice chairmen of the Fatherland Front Committee and the number of executive committee members, standing committee members, vice chairmen (deputy secretaries) of socio-political organizations in the administrative unit after the arrangement in accordance with local reality.
Arrangement of cadres, civil servants and public employees at district level
Temporarily suspend the election and appointment of leadership and management positions and the recruitment and acceptance of cadres, civil servants and public employees at specialized advisory and support agencies, public service units of Party committees, the Fatherland Front, and socio-political organizations in district-level administrative units that must be reorganized (agencies and units) from the date the Provincial People's Committee submits to the Government the project on reorganization of district-level administrative units until the resolution of the National Assembly Standing Committee on the arrangement of each corresponding administrative unit takes effect, except in cases where there is a vacancy for a head and it is not possible to arrange a person in charge according to regulations of the competent authority, then that position can be elected and appointed.
The Standing Committee of the provincial Party Committee leads, directs, and guides the subordinate Party Committees to perform the following tasks: (1) Develop projects, decide on the establishment, stipulate the functions, tasks, organizational structure, staffing, and working relationships of the agencies and units in the newly established district-level administrative units; arrange heads and deputy heads of each agency and unit according to the regulations of the Central Executive Committee, the Politburo, and the Secretariat. Cadres and civil servants who cease to hold leadership positions(including election, appointment)or holding a leadership position with a lower position allowance than when the district-level administrative unit was not yet arranged, having sufficient qualities, capacity, standards, conditions and having at least 30 months of working time until retirement, will be given priority when recommending for election or appointment to the position held before the district-level administrative unit was arranged or equivalent positions; (2) Develop and complete the list and number of job positions, restructure the staff of civil servants and public employees at the new agency or unit in sync with the agencies and units of the political system in the newly established district-level unit; (3) Develop a plan, roadmap and implement the arrangement to reduce the number of leaders and managers; the number of redundant civil servants and public employees associated with streamlining the payroll at the new agency or unit according to the regulations of the Party and the State, ensuring compliance with local reality.
The Standing Committee of the provincial Party Committee leads, directs, and guides the subordinate Party Committees to arrange and organize to reduce the number of leaders and managers in new agencies and units; no later than 60 months from the effective date of the decision to establish the organization, it must comply with general regulations; at the same time, it must continue to streamline the payroll according to the conclusions, regulations, and decisions of the Politburo and the Central Organizing Committee. In special cases, the Standing Committee of the provincial Party Committee shall report to the Central Organizing Committee to submit to the competent authority for consideration and decision.
Arrangement of staff at commune level
Temporarily suspend the election of commune-level officials(including: secretary, deputy secretary of the Party Committee, chairman of the Fatherland Front Committee, head of political and social organizations at the commune level)Administrative units must be reorganized from the date the provincial People's Committee submits to the Government the project to reorganize commune-level administrative units until the resolution of the National Assembly Standing Committee on the arrangement of each corresponding administrative unit takes effect, except in cases where there is a vacancy in the head and no person in charge can be arranged according to regulations of the competent authority, then that position will be elected.
The arrangement and placement of commune-level cadres after the arrangement of administrative units must be carried out synchronously and in connection between organizations in the political system. Priority is given to the arrangement and placement of commune-level cadres with sufficient qualities, capacity, standards and conditions for equivalent positions or priority is given to the nomination for election to positions of cadres at commune-level administrative units when needed or priority is given to recruitment as civil servants (district and commune level) if qualified and qualified.
The Standing Committee of the provincial Party Committee shall lead, direct and guide the subordinate Party Committees to develop plans, roadmaps and implement arrangements to reduce the number of specialized cadres at the commune level, ensuring that no later than 60 months from the effective date of the decision to establish the organization, it shall comply with general regulations. In special cases, the Standing Committee of the provincial Party Committee shall report to the Central Organizing Committee to submit to the competent authority for consideration and decision.
