Instructions for determining gestational age to calculate maternity benefits for employees
The Ministry of Health issued document 6638/BYT-BM-TE providing guidance on determining gestational age to calculate benefits for workers.
- Accordingly, the competent medical facility shall determine the gestational age according to the provisions of Decision 4128/QD-BYT dated July 29, 2016 on approving the National Guidelines on Reproductive Health Care Services issued by the Minister of Health as follows:
- Gestational age is calculated from the first day of the last menstrual period; In case of conception by intrauterine insemination or in vitro fertilization, the first day of the last menstrual period is determined to be 14 days before intrauterine insemination or embryo transfer into the woman's uterus.

- If a woman cannot remember the first day of her last menstrual period, the gestational age can be calculated based on the ultrasound results.

Thus, to enjoy maternity policies, pregnant women need to present pregnancy examination results issued by a medical facility with pregnancy examination functions, which includes the results of determining the gestational age at the time of examination.
