Cancel decisions on personnel work that are not correct with Mr. Le Phuoc Hoai Bao

On December 12 and 13, 2017, in Hanoi, the Central Inspection Commission held its 20th meeting. Comrade Tran Quoc Vuong, Politburo member, Party Central Committee Secretary, and Chairman of the Central Inspection Commission chaired the meeting.

Overview of the 20th session of the Central Inspection Commission.

At this meeting, the Central Inspection Commission (CIC) reviewed and concluded the following main contents:

I- Consider kInspection results of the Provincial Party Committee, the Standing Committee of the Provincial Party Committee, and the Inspection Commission of the Thanh Hoa Provincial Party Committee on the implementation of party discipline against comradeNgo Van Tuan,Provincial Party Committee member, Party Executive Committee member, Vice Chairman of the Provincial People's Committee, former Party Committee Secretary, former Director of the Department of Construction and comradeDao Vu Viet,Provincial Party Committee Member, Party Secretary, Director of Department of Construction

1- Comrade Ngo Van Tuan has the following violations and shortcomings:

From October 2010 to November 2015, as Party Secretary and Director of the Department of Construction, he violated the principle of democratic centralism and violated the regulations of the Party and State on organization and personnel work, specifically:

- Violating the regulations of the Thanh Hoa Provincial Civil Servant Examination Council in 2011; issuing an unauthorized decision on the establishment of the Civil Servant and Civil Servants Selection Council of the Department of Construction.

With the responsibility as Director of the Department of Construction, Secretary of the Party Committee of the Agency, he has unfairly favored and supported Ms. Tran Vu Quynh Anh in making decisions on personnel work that violate the regulations of the Party and the State such as: Receiving and transferring Tran Vu Quynh Anh from a contract employee at a public service unit to work as a professional civil servant; in a very short time appointing her as Deputy Head of Department, Head of Department, proposing to plan the position of Deputy Director of the Department; admitting her to the Party, joining the Party Committee of the Department of Construction.

- Issuing decisions on standards for appointing officials without proper authority, violating standards for officials prescribed by competent authorities; appointing many department heads and deputy department heads who do not meet the conditions and standards, of which the typical case is Ms. Tran Vu Quynh Anh.

- The decision to establish a number of new specialized departments under the Department of Construction is beyond its authority and against the policies of the Party and State on administrative reform, streamlining of organizational structure and staffing.

2- Comrade Dao Vu Viethas the following violations and shortcomings:

- In his position as Deputy Director (from October 2013 to November 2015) and Director of the Department of Construction (from December 2015 to present), he violated regulations on organization and personnel work. Signed decisions to establish new departments beyond his authority, exceeding the prescribed number; signed decisions to appoint a number of department heads and deputy department heads who did not meet the conditions and standards, exceeding the prescribed number.

- Lack of responsibility in not reporting to the Department of Home Affairs, not publicizing to the staff and civil servants in the agency about the decision to dismiss Ms. Tran Vu Quynh Anh; allowing the Chief of Office of the Department of Construction to hand over the decision to dismiss Ms. Tran Vu Quynh Anh and the staff and civil servant records against regulations and taking responsibility for the management of Tran Vu Quynh Anh's party membership.

- Take primary responsibility for the violations and shortcomings of the Party Committee of the Department of Construction in the period 2015-2016 and jointly take responsibility of the Party Committee of the Department for the violations and shortcomings in the period 2013-2015.

The violations and shortcomings of comrade Ngo Van Tuan are very serious, those of comrade Dao Vu Viet are serious. The violations and shortcomings of the two comrades occurred over a long period of time, were systematic, and resulted in a number of party organizations and many cadres and party members committing violations and shortcomings having to be disciplined; causing resentment and doubt among cadres, party members and the people, negatively affecting the reputation of the Party Committee of the Department of Construction, the Standing Committee of the Provincial Party Committee and the leadership of Thanh Hoa province. However, the Executive Committee of the Thanh Hoa Provincial Party Committee only considered and disciplined comrade Ngo Van Tuan at the level of reprimand and did not discipline comrade Dao Vu Viet, which is not commensurate with the nature and level of the violation according to the Party's regulations.

Pursuant to Regulation No. 102-QD/TW of the Politburo on disciplinary action against violating Party members, the Central Inspection Commission decided to take disciplinary action.warningfor comradesDao Vu Viet. The Central Inspection Commission requested the Thanh Hoa Provincial Party Committee and the Standing Committee of the Thanh Hoa Provincial Party Committee to seriously review and draw profound lessons from the above incident; to inspect, review and rectify the organization and personnel work in the entire province.

- Loose leadership, allowing the Provincial People's Committee and competent agencies to recruit civil servants, select officials without examination, transfer, rotate, and appoint some cases that do not meet the conditions and standards, violate principles, processes, and procedures, and show favoritism to children of the Provincial Party Secretary and Provincial People's Committee Chairman.

2- ComradeLe Phuoc Thanh, Provincial Party Secretary for the 2010-2015 term, Party Committee Secretary, Chairman of the Provincial People's CommitteeQuang Namterm 2011-2016

- As the leader, he is primarily responsible for the violations and shortcomings of the Provincial Party Committee Standing Committee for the 2010-2015 term and the Provincial People's Committee Party Committee for the 2011-2016 term.

- Violating the principle of democratic centralism, the Working Regulations and the regulations of the Party and the State on personnel work; not being exemplary, showing favoritism and favoritism for the family in planning, transferring, assigning and deciding to appoint comrade Le Phuoc Hoai Bao (his son) to positions (Head of the Chu Lai Open Economic Zone Management Board, Vice Chairman of the People's Committee of Thang Binh district, Deputy Director, Director of the Department of Planning and Investment) not meeting the standards and conditions, violating the process and procedures; allowing the Provincial People's Committee to decide to send comrade Le Phuoc Hoai Bao to study for a Master's degree abroad using the State budget, not in accordance with regulations.

3- Comrade Dinh Van Thu, Deputy Secretary of the Provincial Party Committee, Secretary of the Party Committee, Chairman of the Provincial People's Committee

- As Deputy Secretary of the Provincial Party Committee, Secretary of the Party Committee, Chairman of the Provincial People's Committee and previously Deputy Secretary of the Party Committee, Vice Chairman of the Provincial People's Committee, he is partly responsible for the violations and shortcomings of the Party Committee of the Provincial People's Committee for the 2011-2016, 2016-2021 terms and the Standing Committee of the Provincial Party Committee.

- Not being a good example when signing documents requesting the appointment of a son when the planning has not been approved; allowing the Provincial People's Committee to recruit civil servants without taking exams, appointing a son to leadership positions who does not meet the conditions and standards.

4- Comrade Huynh Khanh Toan, Member of the Provincial Party Standing Committee, Deputy Secretary of the Party Committee, Permanent Vice Chairman of the Provincial People's Committee

- As a member of the Provincial Party Standing Committee, Deputy Secretary of the Party Committee, Vice Chairman of the Provincial People's Committee, you are jointly responsible for the violations and shortcomings of the Provincial Party Standing Committee and the Party Committee of the Provincial People's Committee; you signed the report of the Provincial People's Committee submitted to the Ministry of Home Affairs on personnel work and appointed comrade Le Phuoc Hoai Bao to the position of Director of the Department of Planning and Investment with some inaccurate contents.

- During his time as Party Secretary and Head of the Chu Lai Open Economic Zone Management Board, he violated the principle of democratic centralism and the Party and State's regulations on personnel work; proposed recruiting civil servants without examination, directed planning, proposed rotation and appointment for a number of cases that did not meet the conditions and standards, including children of key officials of the province.

5-Comrade Le Phuoc Hoai Bao, Provincial Party Committee member, Director of Department of Planning and Investment

- Dishonest in declaring one's work history in the profile, resume and personnel file of the candidate for the Provincial Party Executive Committee for the 2015-2020 term.

- Poor sense of organization and discipline; violating the principles of organizing Party activities, missing Party activities for many months, not transferring Party activities according to regulations while studying for a Master's degree abroad.

The Standing Committee of the Quang Nam Provincial Party Committee is responsible for the violations committed by the above organizations and individuals, which have been lax in their leadership, inspection, and supervision of the Party Committee of the Provincial People's Committee; have not strictly followed the Working Regulations, allowing the Party Committee of the Provincial People's Committee and a number of provincial leaders to commit violations and shortcomings.

The violations and shortcomings of comrade Le Phuoc Thanh are very serious; the violations and shortcomings of comrade Dinh Van Thu, comrade Huynh Khanh Toan and comrade Le Phuoc Hoai Bao are serious, negatively affecting the reputation of the Party organization and individuals, causing public outrage among cadres, party members and the people. The Central Inspection Committee decided to conduct the disciplinary process for comrades Le Phuoc Thanh, Dinh Van Thu and Huynh Khanh Toan.

The Central Inspection Commission requests the Standing Committee of Quang Nam Provincial Party Committee:

+ Direct the party organization and competent authorities to carry out procedures to remove the name from the party member list and cancel incorrect decisions on personnel work regarding comrade Le Phuoc Hoai Bao.

+ Seriously review and draw profound lessons; organize reviews and handle responsibilities for the Party Executive Committee of the People's Committee of Quang Nam province and related collectives and individuals according to authority.

III- Consider and propose to discipline the Standing Committee of Vinh Phuc Provincial Party Committee for the 2010-2015 term; Comrade Pham Van Vong, former member of the Party Central Committee, Secretary of the Provincial Party Committee for the 2010-2015 term, Chairman of the Provincial People's Council for the 2011-2016 term; discipline Comrade Phung Quang Hung, Deputy Secretary of the Provincial Party Committee for the 2010-2015 term, Secretary of the Party Committee, Chairman of the Vinh Phuc Provincial People's Committee for the 2011-2016 term.

The Central Inspection Commission has reviewed the violations and shortcomings of the Standing Committee of Vinh Phuc Provincial Party Committee for the 2010-2015 term, comrade Pham Van Vong and comrade Phung Quang Hung as concluded at the 19th Session of the Central Inspection Commission.

The Central Inspection Commission found that the violations and shortcomings of the Standing Committee of the Vinh Phuc Provincial Party Committee for the 2010-2015 term, comrade Pham Van Vong and comrade Phung Quang Hung were serious, negatively affecting the reputation of the Party organization and individuals.

Pursuant to Regulation No. 263-QD/TW and Regulation No. 102-QD/TW of the Politburo on disciplinary action against violating Party organizations and Party members, the Central Inspection Commission decided to issue a warning to comrade Phung Quang Hung; request the Politburo and the Secretariat to issue a disciplinary action against the Standing Committee of the Vinh Phuc Provincial Party Committee for the 2010-2015 term and comrade Pham Van Vong according to their authority.

IV- Review and discipline comradesNguyen Thanh Son, former member of the Provincial Party Standing Committee, former Secretary of the Provincial Party Committee of Provincial AgenciesandComrade Le An Tinh, former member of the Standing Committee of the District Party Committee, former Head of Dak Song District Police, Dak Nong Province

1- ComradeNguyen Thanh Sonhas the following violations and shortcomings:

During his tenure as Director of the Department of Planning and Investment, Secretary of the Party Committee of the Provincial Agencies, comrade Nguyen Thanh Son and his family, although not eligible or meeting the criteria, declared the origin of reclaimed land incorrectly, legalized procedures, submitted a request and were granted a land use right certificate with an area of ​​41.5 hectares, violating the provisions of the law on land, regulations on what party members are not allowed to do and the exemplary responsibility of cadres and party members.

The violations and shortcomings of comrade Nguyen Thanh Son have affected the prestige of the Party organization and the individual. Pursuant to Regulation No. 102-QD/TW of the Politburo, the Central Inspection Commission decided to take disciplinary action againstwarningfor comradesNguyen Thanh Son.

2- ComradeLe An Tinhhas the following violations and shortcomings:

During his time as District Police Chief, he signed a contract to receive 28 hectares of forest allocated to the wrong subjects, without meeting the conditions and standards. After receiving the forest land allocation, he failed to manage the allocated area, allowing most of the forest land to be cut down; arbitrarily used it for the wrong purpose, violating the provisions of the law on land, the provisions on what party members are not allowed to do, and the exemplary responsibility of cadres and party members.

The violations and shortcomings of comrade Le An Tinh have affected the prestige of the Party organization and the individual. Pursuant to Regulation No. 102-QD/TW of the Politburo, the Central Inspection Commission decided to take disciplinary action againstreprimandfor comradesLe An Tinh.

V- Also at this Session, the Central Inspection Commission considered and resolved 01 denunciation; considered and resolved 05 party disciplinary complaints under its authority; and gave opinions on resolving 01 disciplinary complaint under the authority of the Secretariat.
