Plan to implement the Law on Environmental Protection in 2014

Pursuant to Directive No. 26/CT-TTg dated August 25, 2014 of the Prime Minister on the implementation of the Law on Environmental Protection 2014, the Provincial People's Committee has developed a Plan to implement the Law on Environmental Protection 2014 in the province as follows:

1. Thoroughly grasp, train, propagate and popularize the Law on Environmental Protection 2014

Thoroughly grasp, train and widely disseminate the Law on Environmental Protection and documents guiding the implementation of the law for key leaders of agencies, organizations and units from the province to the grassroots level; cadres, civil servants, public employees and employees of the Department of Natural Resources and Environment of districts, cities and towns; officers in charge of the environment of communes, wards and towns; representatives of leaders and officers in charge of the environment of enterprises in the province; households, individuals and communities in the province to raise awareness of policies and laws on environmental protection, limit violations caused by ignorance of the law on environmental protection, contribute to political stability, social order and safety, and promote sustainable development of the local economy.

1.1. Organizing training conferences

Disseminate the Law on Environmental Protection and Decree No. 18/2015/ND-CP dated February 14, 2015 regulating environmental protection planning, strategic environmental assessment, environmental impact assessment and environmental protection plans; Decree No. 19/2015/ND-CP dated February 14, 2015 detailing the implementation of a number of articles of the Law on Environmental Protection and related documents.

Implementation and training documents: Law on Environmental Protection 2014, Government Decrees on the implementation of the Law on Environmental Protection and related documents.

- At provincial level: Time: Quarter II, 2015

- District level: Time: Quarter II - III, 2015

- Commune level: Time: no later than 30 days after implementation at district level.

1.2. Organizing the introduction and dissemination of the Law in other forms

Organize the dissemination, popularization and education of environmental laws regularly with practical content and appropriate forms for each target audience (radio, television, newspapers, electronic information portals, legal Q&A, leaflet distribution, organizing conferences on topics...) to fully convey the contents of the Law on Environmental Protection, Decrees and Circulars guiding the implementation so that all classes of people can grasp and properly implement the provisions of the Law. Organize competitions to learn about the Law on Environmental Protection 2014 with appropriate forms from commune to district and provincial levels.

Compile and publish documents such as leaflets and brochures to distribute to households and individuals in the province.

Organize the printing of books on the Law on Environmental Protection 2014 and Decree No. 18/2015/ND-CP dated February 14, 2015 regulating environmental protection planning, strategic environmental assessment, environmental impact assessment and environmental protection plans; Decree No. 19/2015/ND-CP dated February 14, 2015 detailing the implementation of a number of articles of the Law on Environmental Protection 2014 to distribute to environmental officers at the commune, district and provincial levels.

Implementation time: 2015.

2. Organize the review and development of current legal documents on the environmental field under the authority of promulgation; compile statistics on documents that need to be amended, supplemented, replaced or abolished to comply with the Law on Environmental Protection.

- Direct the handling of transitional issues in implementing the Law on Environmental Protection, remove obstacles when receiving and handling administrative procedures on Environmental Protection such as appraisal of environmental impact assessment reports, environmental protection commitments, hazardous waste management, environmental protection projects... when the guiding documents have not yet taken effect.

- Review and develop legal documents on environmental protection of the People's Council and the Provincial People's Committee, determine documents that have expired or are no longer in accordance with the provisions of the Law on Environmental Protection and the implementing Decrees, then they must be abolished or newly issued.

- Advise on promulgating strategies and plans to implement environmental protection strategies in Nghe An province in 2020, with a vision to 2030.

Time of issue: Quarter IV, 2016.

- Advise on the issuance of documents assigning tasks and authorizing the organization to appraise environmental restoration plans and supplementary environmental restoration plans for mineral exploitation projects according to the provisions of Decree No. 19/2015/ND-CP dated February 14, 2015 detailing the implementation of a number of articles of the Law on Environmental Protection 2014.

Time of issue: Quarter III, 2015

3. Administrative reform in environmental protection management

- Review the set of administrative procedures related to state management of the environment, supplement or develop new ones in accordance with the Law on Environmental Protection and guiding documents, especially Decree No. 18/2015/ND-CP dated February 14, 2015 on environmental protection planning, strategic environmental assessment, environmental impact assessment and environmental protection plan.

- Well implement administrative reforms related to state environmental management according to the provisions of Decision No. 06/2015/QD-UBND dated January 21, 2015 of Nghe An Provincial People's Committee promulgating regulations on procedures for implementing direct investment projects using land in Nghe An province.

4. Continue to strengthen state management of environmental protection in the province.

In the coming time, to strengthen state management of environmental protection in the province, it is necessary to focus on implementing the following tasks:

- Continue to effectively implement Decision No. 5005/QD-UBND dated October 29, 2013 of the Provincial People's Committee on promulgating the Plan to implement Resolution No. 35/NQ-CP dated June 18, 2014 of the Government on a number of urgent issues in the field of environmental protection in Nghe An province; Plan to implement Resolution No. 24-NQ/TU dated June 3, 2013 of the 11th Party Central Committee on proactively responding to climate change, strengthening resource management and environmental protection.

- Strictly control sources of environmental pollution, especially in craft villages, industrial parks and clusters, mineral exploitation and processing areas, and concentrated livestock farms; urge the handling of establishments causing serious environmental pollution; focus on environmental protection in rural areas to support the completion of environmental protection criteria under the new rural program and river basins; forecast establishments at risk of causing environmental pollution.

- Inspect and supervise the remediation of facilities causing serious environmental pollution according to the plan to thoroughly handle facilities causing serious environmental pollution by 2020 according to Decision No. 1788/QD-TTg dated October 1, 2013; Plan to handle and prevent environmental pollution caused by residual plant protection chemicals nationwide in Decision No. 1946/QD-TTg of the Prime Minister and the Provincial People's Committee; review and supplement the list of newly emerging facilities causing serious environmental pollution and develop a monitoring plan.

- Strengthen the inspection of compliance with environmental protection laws periodically and suddenly to assess, warn and predict the risk of environmental pollution and environmental incidents at production and business establishments; propose measures to prevent, overcome pollution and restore the environment promptly; handle violations of environmental protection laws, resolve complaints and denunciations, and recommendations related to environmental protection in the area.

- Continue to improve the quality of appraisal and licensing work on environmental protection including: Environmental impact assessment reports, environmental protection plans, environmental rehabilitation projects; environmental protection projects, hazardous waste management... according to the Law on Environmental Protection 2014 and guiding Decrees and Circulars.

- Prepare reports on environmental protection work at all levels and submit them to the People's Councils at the same level, including assessments of the current status and developments of environmental components, scale, nature and impacts of emission sources, forecasts and directions for solving environmental problems in the areas under their management.

- Build an environmental monitoring and environmental information system; investigate and compile statistics on waste sources, and assess the current environmental status in the area under its management.

- Complete the Plan to handle facilities causing serious environmental pollution according to Decision 64/2003/QD-TTg dated April 22, 2003 of the Prime Minister.

- Implement the Provincial Environmental Protection Plan according to the provisions of Decree No. 18/2015/ND-CP dated February 14, 2015 regulating environmental protection planning, strategic environmental assessment, environmental impact assessment and environmental protection plan.

- Strengthen inspection and supervision of environmental protection activities of state management agencies according to the provisions of the Law on Environmental Protection 2015.
