Results of handling voters' petitions at the 5th session of the 16th Provincial People's Council

(Baonghean) -At the 5th session, there were a total of 43 contents proposed by the Provincial People's Council delegates and voters. The Provincial People's Council and the Provincial People's Committee directed to resolve all 43 contents mentioned above. The Provincial People's Committee clearly presented 16 contents as follows:

First content:Voters of Hung Loc commune, Vinh city and some other voters proposed to widen Le Viet Thuat street; build ramps from the local crossroads and inner-field roads to the main road at roads 558 (8A), 8B, and Vinh bypass to ensure people's lives.
The Provincial People's Committee would like to report as follows:

1. Regarding investment in expanding Le Viet Thuat Street.


Le Viet Thuat Street is a Provincial Road managed by the Department of Transport, currently degraded, the road surface width is not guaranteed, affecting people and vehicles participating in traffic on the road. On September 7, 2012, the Provincial People's Committee approved the investment project: Upgrading and expanding Provincial Road 535, Vinh - Cua Hoi section, in Decision No. 3430/QD.UBND, with a total investment of 2,508.2 billion VND, with an urban road scale of 45m wide, 11km long.

On October 2, 2012, the Provincial People's Committee approved the bidding plan for phase 1 in Decision No. 3752/QD.UBND-GT. Currently, the investor (Department of Transport) is implementing the next steps to soon start construction and complete the project on schedule.

2. Regarding investment in upgrading bridges on Provincial Road 598A (now changed to Provincial Road 531).

In 2007, the DT.531 route from Km34 to Km58 was upgraded and renovated by the Ministry of Transport using loans from the Asian Development Bank (ADB), but only the road part was invested in, while Hieu and Dinh bridges were kept in their original state for exploitation. Due to the nature of the project being an overflow bridge, during the rainy season, these locations are often flooded, and due to the long construction period, they have now deteriorated. On October 21, 2011, the Provincial People's Committee issued Decision No. 4414/QD.UBND-CN allowing the establishment of an investment project to build Hieu and Dinh bridges. Currently, the Department of Transport is actively implementing the investment project and arranging capital to soon start construction of the project.

3. Regarding the construction of ramps from residential crossroads and intra-field roads to the main road at Road 558 (8A), Road 8B:

The Provincial People's Committee has directed the Department of Transport to work and agree with the locality to fully supplement the system of residential ramps. Of which, Road 8A has 76 points, Road 8B has 45 points. Currently, the Provincial People's Committee is actively urging construction units to deploy construction to complete early, serving the travel of the people.

Content 2:Voters reported that the Vai Rau Mountain area in Hung Yen Bac Commune has been licensed to exploit stone and construction materials for Invecon Company with an area of ​​nearly 10 hectares. However, voters are concerned that the exploitation will cause environmental pollution and affect Khe Ngang Lake.

The Provincial People's Committee would like to report as follows:

Invecon International Trading and Investment Consulting Joint Stock Company was granted a license by the Provincial People's Committee to exploit construction stone at Vai Rau Mountain, Hung Yen Commune, Hung Nguyen District in 2009. On October 5, 2012, the inspection team of the Department of Natural Resources and Environment inspected to verify the voters' petition. At the time of the inspection, the Company had not yet started mining.

If the company proceeds with mining, the issues of wastewater, emissions and noise are handled as follows:

- Regarding wastewater: According to the approved environmental impact assessment report, wastewater and overflow rainwater generated from the mine area must be treated to meet current environmental standards before being allowed to be discharged into the lake as prescribed.

- The company commits that when mining, the products after mining will be transported along the same route with Phuoc Thuy private enterprise, so it will not affect the residential area of ​​Khe Ngang lake. On the other hand, the distance from the mine area to the residential area of ​​Da Da hamlet is about 700m and through Khe Ngang lake, so during mineral exploitation activities, it will not directly affect the residential area.

The inspection team requested the Company to build environmental protection works in accordance with the committed content before proceeding with exploitation.

During the mining process, if environmental pollution occurs, the Company is required to temporarily stop mining in the mine area.

Third content:Voters proposed to reclaim land from forestry farms to hand over to local authorities for management and grant land to people for production.

The Provincial People's Committee reports as follows:

In the past time, the Provincial People's Committee assigned the Department of Natural Resources and Environment to preside over and coordinate with the Department of Agriculture and Rural Development, the People's Committees of districts to inspect and review the land use of a number of agricultural and forestry farms, and protective forest management boards in the whole province and advised the Provincial People's Committee to reclaim 4,406.5 hectares of forestry and agricultural land in the districts of Quy Chau, Quy Hop, Thanh Chuong, etc. so that the People's Committees of the districts have a basis to hand over to the people for production (including: Reclaimed from the Quy Chau Protective Forest Management Board: 588.6 hectares, Thanh Chuong Protective Forest Management Board: 2,297.6 hectares, Quy Hop Forest Farm: 31.4 hectares and Dong Hop Forest Farm: 1,488.9 hectares). After the Provincial People's Committee issued the Decision on land reclamation, the Department of Natural Resources and Environment issued documents urging and guiding the People's Committees of the districts to urgently develop plans to hand over forestry land to the people for production in accordance with the provisions of law.

Fourth content:Voters requested the province to have a plan to compensate and relocate households affected by the Ban Mong Hydropower Project so that people can feel secure and focus on production and economic development. Voters requested the province to soon reclaim part of the land of the forestry farm and protective forest that is capable of agricultural production to hand over to people subject to resettlement at the Ban Mong Hydropower Plant in Quy Chau district.

The Provincial People's Committee reports as follows:

The Ban Mong Reservoir Construction Investment Project was approved by the Ministry of Agriculture and Rural Development on May 26, 2009 with a total investment of over VND 4,455 billion. The project consists of 4 main components, including compensation, resettlement, and site clearance.

The compensation, support, resettlement and site clearance component was approved for investment by Nghe An Provincial People's Committee in Decision No. 1984 dated May 8, 2009 with a total investment of more than VND 860 billion and started construction in May 2010.

Objective of the component: Ensure that organizations and households affected by the project move to new residences and stabilize their lives.

To minimize resettlement, the Ministry of Agriculture and Rural Development and the People's Committee of Nghe An province have agreed to add the auxiliary dam and Chau Binh drainage canal to the compensation and resettlement component of the Ban Mong Reservoir Project. After adding the auxiliary dam and Chau Binh drainage canal, the number of households that still need to be relocated in Quy Chau district is 361.

Resettlement plan for 361 households is as follows:

- Through community consultation to get opinions on resettlement of households that had to be relocated, 150 households agreed to voluntary resettlement and 211 households had to be resettled.

- Currently, Ban Mong Project Management Board is planning 2 resettlement areas including:

+ Ban Dung resettlement area in Yen Hop commune, Quy Hop district: Arranged for 65 households. Currently, the design and construction drawings of the resettlement area have been approved, but due to lack of capital, construction has not been organized.

+ Khe Ang resettlement area in Nghia Mai commune, Nghia Dan district: Arrange for about 200 households. Currently, the investment project is being established.

It is expected that by the end of 2014, compensation and resettlement work for the Ban Mong Reservoir project in Quy Chau district will be completed.

Fifth content:Voters recommend that there should be active solutions in land management, especially in implementing agricultural land planning. There should be specific instructions on continuing to convert agricultural land from small plots to large plots, to achieve the goal of building new rural areas and building large-scale fields. There should be solutions to strongly direct districts, cities and towns to do a good job of environmental sanitation and build waste treatment areas.

Regarding this issue, the Provincial People's Committee would like to report as follows:

- Currently, the land use planning of Nghe An province until 2020 and the land use plan for the period 2011 - 2015, including the agricultural land planning, have been appraised by the Ministry of Natural Resources and Environment and are being submitted to the Government for approval.

- The Provincial People's Committee issued Decision No. 2928 dated August 6, 2012 on the promulgation of a plan to mobilize farmers to "consolidate land and exchange plots" according to Directive No. 08 of the Provincial Party Standing Committee. On August 15, 2012, the Department of Natural Resources and Environment issued Document No. 2387 promulgating Guidelines for organizing the implementation of "consolidation of land and exchange of plots", including a sample project for local authorities at all levels to have a basis for easy implementation; At the same time, there are documents urging units to organize and implement. In the immediate future, each district will pilot 1 commune in 2012, then expand and complete in 2016. At this session, the Provincial People's Committee also submitted to the Provincial People's Council a Resolution on a number of policies to support investment in building large-scale field models, including support for field improvement after land consolidation and plot exchange of 300 million VND for 1 large-scale field model.

Content 6:The policy of developing farms is necessary but must be based on planning, avoiding arbitrarily breaking agricultural planning, affecting production. Voters suggested carefully considering when reclaiming people's land to give to businesses (such as TH Milk Company) because people are living mainly on production on their family land.

Regarding this content, the Provincial People's Committee would like to report as follows:


Regarding the project of raising cows and processing milk on an industrial scale invested by TH Dairy Foods Joint Stock Company: This is a large-scale investment project in the agricultural production sector. The Provincial People's Committee approved the planning and granted an investment certificate for the project. The land recovery and land lease to the Company in the past time were ensured to be in accordance with the provisions of law. The land fund for TH Dairy Foods Joint Stock Company to lease to implement the project was mainly taken from the land fund of agricultural and forestry farms to return ineffective land areas, or areas that are not in need of use, etc.). As for the production land of the people being managed and used in the province, in case TH Dairy Foods Joint Stock Company has a need to lease, contribute capital, receive transfers, etc., it must negotiate with the people and must have the people's consent before it can use it (authorities at all levels are not allowed to interfere in the land recovery of the people for lease to TH Dairy Foods Joint Stock Company).

Content 7:Voters of Que Phong district proposed to soon provide capital to implement the new rural construction program for the district, in which priority is given to investment capital for poor districts over other districts.

Regarding this issue, the Provincial People's Committee would like to report as follows:


According to Decision 695/QD-TTg, priority should be given to mountainous districts and poor districts under Program 30a. However, due to difficulties in capital sources for direct investment support, it is not possible to balance. For districts under Program 30a, capital is mainly combined from other project programs, such as: capital of Program 30a (about 150 billion VND/year), Program 134, 135...

Content 8:Voters suggested that it is necessary to continue investing in new irrigation works, repairing and upgrading damaged works; the current irrigation fee payment procedures are too cumbersome.

The Provincial People's Committee would like to report as follows:


Due to limited budget, the Provincial People's Committee only allocates 6-10 billion VND annually to repair weak projects before the flood season. Nghe An is a large province with a canal system of thousands of kilometers, with such a budget, it cannot meet the annual repair needs. Therefore, it is mainly the people and localities who mobilize to repair and overcome.

The central budget for irrigation fee exemption for Nghe An province in 2012 is 181 billion VND. The provincial People's Committee provided the first advance to localities and units according to Decision No. 404 dated February 16, 2012, which is 65.6 billion VND. After localities and units complete the documents and budget estimates approved by the provincial People's Committee, the remaining budget will be provided.

Regarding the documents and procedures for exemption from irrigation fees, they are implemented according to the instructions in Circular No. 36/2009/TT-BTC dated February 26, 2009 of the Ministry of Finance. The Provincial People's Committee and localities do not require any additional documents or procedures.

The Provincial People's Committee assigned the Department of Agriculture and Rural Development to direct localities to make timely settlements so as not to affect the progress of funding allocation for the following year.

Content 9:Voters suggested speeding up the construction of Ba Ra Nam Dan 2 culvert, because if it is delayed, it will greatly affect people's traffic and be dangerous during the upcoming storm and flood season.

The Provincial People's Committee would like to report as follows:


According to the report, the Project Management Board (Nam Irrigation One Member Co., Ltd.) has been actively directing construction units to focus on speeding up the progress, completing the culvert and boat lock headworks, traffic bridges on the culvert and lock to ensure safety during the rainy and stormy season, ensuring people's traffic; and soon completing the irrigation pumping station to serve agricultural production in a timely manner.

Content 10:Households in Chau Khe, Thach Ngan, Cam Lam communes of Con Cuong district have been part of the project to replace shifting cultivation with afforestation since 2011. Up to now, people have not received rice support according to regulations.

The Provincial People's Committee would like to report as follows:


Implementing Joint Circular No. 52/2008/TTLT-BNN-BTC dated April 14, 2008 on guiding rice subsidies for ethnic minorities in mountainous areas to plant forests instead of shifting cultivation, the Forest Protection Department has built a project in 6 mountainous districts. The total area of ​​forest planted on shifting cultivation land is 907.2 ha.
On May 8, 2012, the Provincial People's Committee issued Decision No. 1528/QD-UBND.TM on funding for rice subsidies for households participating in the project. Up to now, according to the report of Nghe An Forest Protection Department, the bidding for rice supply to households in 6 districts has been completed (completed in September). The total amount of rice provided is 578.65 tons, the rice provision has been completed (including households in Chau Khe, Cam Lam and Thach Ngan communes, Con Cuong district). Up to now, the project has ended.

Content 11:Voters suggested increasing the number of young, capable, morally qualified, and dedicated teachers for remote areas to replace the number of older teachers who are sent to reinforce their profession, have weak expertise, are not enthusiastic, and have only been reinforced for 2 years, so they are not dedicated to their profession.

Regarding this issue, the Provincial People's Committee would like to report as follows:


The reception, recruitment and transfer of preschool, primary and secondary school teachers are under the authority of the Chairman of the District People's Committee. In general, the recruitment of teachers has been carried out according to the process, in which priority is given to recruiting students with higher academic results and graduation qualifications.

Content 12: Voters propose to provide funding to implement Resolution 30a/2008/NQ-CP to pay salaries for young intellectual volunteers working in poor communes of Que Phong district.

Regarding this issue, the Provincial People's Committee would like to report as follows: The budget to pay salaries for the young intellectual volunteers working in the communes of poor districts (including Que Phong district) is included in the budget for implementing Resolution 30a/2008/NQ-CP. This budget has been transferred to the districts annually according to the budget. In early 2012, due to slow funding, the transfer to the districts was slow; but up to now, enough budget has been transferred to pay salaries for the young intellectual volunteers working in the communes of poor districts according to Resolution 30a/2008/NQ-CP.

Content 13:Voters' recommendations: Mai Son and Nhon Mai communes (Tuong Duong district) do not have car roads, so when there are floods, traffic is often isolated, making people's lives difficult. Voters suggest that the province have effective solutions to help people travel and produce.

The Provincial People's Committee reports as follows:


Nhon Mai and Mai Son are two remote communes of Tuong Duong district, which have never had a car route to the center. To get to the center of the district, people in Nhon Mai and Mai Son communes follow trails and waterways along the Nam Non River, mainly by waterway. The Provincial People's Committee has assigned the Tuong Duong District People's Committee to be the investor in building a road to the center of the two border communes of Nhon Mai and Mai Son (the starting point connecting with the end point of the Yen Tinh - Huu Khuong traffic project) in Decision No. 5892/QD.UBND-CN dated December 30, 2011. The capital source requested for central support comes from government bonds and mobilizes other legal capital sources. Up to now, the District People's Committee has directed the completion of the investment project and is submitting it to the Ministry and branches for appraisal of investment capital sources.

Content 14:The power supply in Hung Yen Nam and Hung Yen Bac communes of Hung Nguyen district is too weak and cannot serve the people. Voters requested support to upgrade the current power station and invest in new power stations; support to build power lines for the three communes of Huu Khuong, Nhon Mai, Mai Son of Tuong Duong district; and the three communes of Chau Phong, Chau Hoan, Dien Lam of Quy Chau district.

The Provincial People's Committee would like to report as follows:


1. The investment in upgrading the power grid of two communes of Hung Yen Nam and Hung Yen Bac, Hung Nguyen district was established by Nghe An Electricity Company in the project "Improving energy efficiency in rural areas, Nghe An province borrowed capital to establish a loan project from the German Reconstruction Bank (KFW)". The progress of the project (KFW) started from June 2012 to June 2014.

2. Support investment in power line construction for 3 communes of Huu Khuong, Nhon Mai, Mai Son of Tuong Duong district; 3 communes of Chau Phong, Chau Hoan, Dien Lam of Quy Chau district.

The above communes have been established by the Department of Industry and Trade with the Project “Providing electricity to mountainous communes and ethnic minority areas without national grid in Nghe An province” and is being submitted to the Ministry of Industry and Trade for approval. However, the progress of investment implementation depends on the progress of capital allocation.

Content 15.Voters proposed to arrange a civil servant position for the commune's agricultural board, because currently at the grassroots level, cadres doing this job are very important but there is no staff, thus causing difficulties for the grassroots in carrying out their tasks, especially in implementing new rural construction.

The Provincial People's Committee would like to respond as follows:


Decree No. 92/2009/ND-CP dated October 22, 2009 of the Government has stipulated the positions of Land Administration - Construction - Urban and Environment (for wards and towns) or Land Administration - Agriculture - Construction and Environment (for communes); each commune is assigned at least 02 civil servants. Therefore, the position of Head of the Agriculture Department will be assigned to 01 civil servant of Land Administration - Agriculture - Construction and Environment. The proposal to add more civil servant positions to the commune agricultural department is not yet feasible, because the Government has stipulated the specific number of civil servant positions for each commune.

Content 16:Voters suggested that the examination for commune civil servants should be reserved for local people. The Party and the State have a policy of nomination for ethnic minority children, but in the recruitment of commune-level civil servants in mountainous and ethnic minority areas, the examination policy is still applied. Voters suggested that there should be specific and reasonable regulations for the selection to create conditions for children to work locally.

The Provincial People's Committee would like to respond as follows:


According to Article 7, Section 1, Chapter 3, Decree No. 112/2011/ND-CP dated December 5, 2011 of the Government on civil servants of communes, wards and towns, it is stipulated that:

Commune-level professional positions are recruited through competitive examinations. For communes in mountainous, border, island, remote, ethnic minority, and particularly difficult socio-economic areas, recruitment can be done through competitive examinations.

The positions of Commune Military Commander and Commune Police Chief conduct recruitment and appointment for qualified people according to regulations.

Thus, according to the Regulations on recruitment of commune-level civil servants in communes and towns in mountainous districts such as Ky Son, Tuong Duong, Con Cuong, Quy Chau and Que Phong, the recruitment method is applied without examination. This regulation has been implemented since 2008. On May 31, 2012, the Provincial People's Committee issued Decision No. 36/2012/QD-UBND regulating the recruitment of commune-level civil servants. Therefore, students who are recruited after graduation and wish to work in the above districts will be recruited according to regulations; If they register for recruitment in localities other than the 5 districts mentioned above, they must go through the recruitment method and enjoy preferential treatment in terms of points as prescribed in the regulations.
