Overcoming overlap, dispersion and waste in planning work
Continuing the 6th session, on the morning of January 10, the National Assembly Standing Committee (NASC) listened to the report and discussed the draft Law on Planning.
The Draft Law on Planning was commented on in groups and halls at the 2nd session of the 14th National Assembly. Based on the opinions of the National Assembly deputies, the Standing Committee of the National Assembly's Economic Committee coordinated with the drafting agency and relevant agencies to study, absorb and revise.
The draft Law has been accepted and developed, including 6 chapters with 69 articles, supplementing a number of points and clauses regulating national marine spatial planning, national land use planning, planning approval, planning adjustment and planning implementation management; reviewing and supplementing the content of reports on types of planning; reviewing and supplementing the planning appraisal procedures; supplementing planning examination procedures in planning approval; reviewing and supplementing regulations related to planning adjustment and planning implementation management...

Affirming the necessity of developing and promulgating the Law, Secretary General of the National Assembly Nguyen Hanh Phuc proposed to review the structure of the draft Law to suit its scope; ensure that the Law regulates issues that need to be planned for in a comprehensive national manner; is compatible with the legal system in general; and when promulgated, does not violate the provisions stipulated in other laws...
According to Chairman of the National Assembly's Council of Ethnic Minorities Ha Ngoc Chien, in implementing development goals, planning is inevitable and there is currently no law on planning, so activities related to planning still overlap.
Therefore, it is necessary to develop and promulgate the Law on Planning, but it is also necessary to review the name and scope of the Law to ensure that it is a framework law and that the provisions are comprehensive. At the same time, it is necessary to review the concepts of planning, national master planning, national sectoral planning and regional planning... to ensure consistency with the content.
Considering that the draft Law raises the issue of national marine spatial planning, but the draft Law has not yet raised the issue of airspace planning, Vice Chairman of the National Assembly Do Ba Ty proposed that airspace planning should be included in the Law and clearly stated "who makes the planning and who manages airspace planning?"
National Assembly Chairwoman Nguyen Thi Kim Ngan requested that the draft Law on Planning be built to ensure its nature as a framework law and to overcome the overlapping, dispersion, and waste in planning work; not to disrupt the existing planning system and must be truly inherited, creating connections and unity between types of planning.
In addition, regarding the basic principles in planning activities, some opinions suggested adding some principles such as ensuring feasibility, synchronization; environmental protection, adaptation to climate change; science; objectivity; ensuring predictability; long-term stability, in accordance with the laws of market economy and international integration requirements; cohesion, unity, no overlap; ensuring connectivity...
At the same time, in the planning process, it is necessary to ensure the best for the people; exploit the advantages of each place, each region, each locality but not increase the development gap between regions and localities; ensure compliance with the requirements on planning principles, order and procedures for planning activities.
Speaking at the end of the discussion on this content, Vice Chairman of the National Assembly Phung Quoc Hien requested that the drafting agency continue to coordinate with relevant agencies, absorb the Standing Committee's opinions on the draft Law, to soon submit the draft Law to the National Assembly for consideration and decision.
At the same time, the Standing Committee also suggested that in the process of receiving and completing the draft Law, it should be designed and built in the spirit that this is a framework law, a law of principle. At the same time, it is necessary to unify the national planning submitted by the Government and approved by the National Assembly and to review the planning system and planning list, the relationship between types of planning; ensuring the principle in planning that the sectoral and local levels must respect the national master plan.
In addition, the agency in charge of drafting the bill also needs to continue reviewing the wording, ensuring legislative techniques in law making...
