On October 14, Ms. Le Kim Yen, representing Mr. Caracciolo David John, who lost nearly 700 million VND, signed a criminal complaint under Article 101 of the Criminal Procedure Code.

Lawyer Truong Xuan Tam said the complaint was sent to the Ho Chi Minh City Police Investigation Agency, Ho Chi Minh City People's Procuracy, District 1 Police, and District 1 People's Procuracy. This complaint denounced a violation of the law, showing signs of the crime of "Fraudulent appropriation of property" under Article 139 of the Penal Code, occurring at Nightfall Restaurant LLC.

At the same time, Ms. Yen received a statement from Mr. Caracciolo David John, certified by Australian authorities, stating that this expense was completely unreasonable. The company was responsible for each expense in the 8 card swipes.

Also according to lawyer Tam, the representative lawyer and Ms. Yen will continue to work with District 1 Police on October 14 and are expected to go to the City Police, possibly then to the Ho Chi Minh City People's Committee to quickly clarify the case.

Previously, on the evening of August 11, Mr. Caracciolo David John (Australian nationality) and a friend went to eat at Nightfall Restaurant, a member of Nightfall Restaurant Company Limited. When paying for the service by bank card, the restaurant staff swiped the card 8 times and asked Mr. John to re-enter the password many times, with the reason that the POS machine was malfunctioning without any invoices or documents.

After returning home and receiving his bank statement, Mr. Caracciolo David John discovered that the amount deducted on the evening of August 11 was up to 39,429 AUD, equivalent to more than 683 million VND.

On September 28, he and his authorized representative returned to two addresses on Thai Van Lung and Nguyen Sieu streets to investigate, but with no results.

The registered address of Nightfall restaurant at 5E Nguyen Sieu, Ben Nghe ward, District 1, where a Western customer had his card swiped and lost nearly 700 million VND, has changed ownership and become a bar.

People living in the area also confirmed that this location was formerly the Nightfall restaurant, but it has been out of business for about a month now.
