Urgent guidance on the implementation of the Labor Code
Directive on handling difficulties in implementing the Labor Code (amended), Prime MinisterdeliverThe Ministry of Labor, War Invalids and Social Affairs urgently develops documents detailing the implementation of this Code.
The Prime Minister noted that the Ministry of Labor, War Invalids and Social Affairs should urgently develop documents detailing the implementation of the Labor Code (amended), including issues specifically assigned by the Code and issues under the management and administration responsibility of the Government, ensuring the unity and synchronization of the labor law system, and submit them to the Government for consideration and decision.
Labor Codewas passed at the 3rd session of the 13th National Assembly and took effect from May 1, 2013.
To implement the Labor Code, according to Decision No.1319/QD-TTgOn September 28, 2012, the Program for drafting documents detailing the implementation of the Laws passed at the 3rd Session of the 13th National Assembly was issued. There will be 11 Decrees detailing and guiding the implementation of the Labor Code, such as: Decree detailing Clause 2, Article 14 of the Labor Code on the organization of employment services; Decree detailing labor contracts; on wages; on working hours, rest hours and labor safety and hygiene; on foreign workers working in Vietnam; on labor disputes; on retirement age...
However, according to the Vietnam General Confederation of Labor, in addition to the issues specified in detail in the Decrees to be developed according to the above-mentioned Government Program and Plan, there are still many issues of the 2012 Labor Code with unclear and unspecific contents. If they are not specified in detail and guided for implementation, there will be many difficulties when applying and implementing the law in practice.
