Urgent guidance on the implementation of the Labor Code

The Prime Minister instructed the Ministry of Labour, Invalids and Social Affairs to urgently develop detailed regulations for the implementation of the amended Labour Code, including issues specifically assigned by the Code and those falling under the Government's management and operational responsibilities, ensuring the consistency and uniformity of the labor law system, and submit them to the Government for consideration and decision.
Labor CodeIt was approved at the 3rd session of the 13th National Assembly and came into effect on May 1, 2013.
To implement the Labor Code, according to Decision No.1319/QD-TTgOn September 28, 2012, the program for drafting detailed regulations for the implementation of laws passed at the 3rd Session of the 13th National Assembly was issued. This program will include 11 decrees detailing and guiding the implementation of the Labor Code, such as: a decree detailing Clause 2, Article 14 of the Labor Code on the organization of employment services; decrees detailing labor contracts; wages; working hours, rest periods and occupational safety and health; foreign workers working in Vietnam; labor disputes; retirement age, etc.
However, according to the Vietnam General Confederation of Labor, in addition to the issues detailed in the Decrees to be developed under the Government's Program and Plan mentioned above, there are still quite a few issues in the 2012 Labor Code that are not detailed or specific enough. If these are not detailed and guided for implementation, many difficulties will arise when applying and enforcing the law in practice.
