Prosecution of former Vice Chairman of Nghi Xuan District People's Committee, Ha Tinh
On the morning of August 16, a source from the Ha Tinh Provincial Police said that the Investigation Police Agency of the Ha Tinh Provincial Police had just prosecuted 3 more subjects, including: Le Duy Viet (54 years old, former Vice Chairman of the Nghi Xuan District People's Committee, former Vice Chairman of the Compensation, Support and Site Clearance Council (BTGPMB) of the Ben Thuy 2 Bridge Project), Nguyen Thi Hong Nhung (39 years old), Nguyen Cong Minh (70 years old, both residing in Xuan An town, Nghi Xuan district) for the act of "intentionally violating the State's regulations on economic management, causing serious consequences".
According to initial information from the investigation agency's documents, the 473 Traffic Construction Company was assigned land by the People's Committee of Ha Tinh province in Block 1, Xuan An town, Nghi Xuan district with an area of over 10,000 square meters. In 2001, this company moved to Vinh city (Nghe An province) and handed over the unit's kindergarten to Block 1, Xuan An town for management. After that, Block 1 had a policy of selling the kindergarten to Nguyen Thi Hong Nhung, a women's cadre of the block, for 70 million VND, but Nhung did not buy it.
In 2007, Ms. Nhung applied for land allocation at the above location (kindergarten) and Block 1 and Xuan An Town People's Committee completed the procedures for land allocation, but because this area had not been planned, the application was not qualified to be sent to Nghi Xuan District People's Committee for land allocation according to regulations. By 2009, the Ben Thuy 2 Bridge Construction Project was implemented, and the staff of the Land Use Rights Registration Office (LURO) drew a diagram of the current land use status of households in Block 1 that were subject to clearance. During the process of measuring the area of the kindergarten, Mr. Nguyen Cong Minh - Block leader, instructed the surveyor to record the name of the land user as Nguyen Thi Hong Nhung and proceed to measure the plot with 2 households Nguyen Van Chien and Phan Van Gioi with an area of 498.5m². The land plot dossier was signed by Mr. Phan Duy Khuong (Chairman of Xuan An Town People's Committee) and Mr. Nguyen Van Hoa (Land Registry officer).
Although she did not buy a kindergarten or receive land, Ms. Nhung discussed with her husband for help to enjoy the compensation policy and support for resettlement land. On October 18, 2011, the District Compensation and Site Clearance Council met to consider and resolve compensation, but no one made any proposals for Ms. Nhung's household. However, Mr. Le Quang Sang (33 years old, Deputy Head of the District Department of Natural Resources and Environment) and Mr. Nguyen Van Duc (54 years old, Deputy Head of the District Department of Natural Resources and Environment, and Vice Chairman of the District Compensation and Site Clearance Council) agreed with Mr. Le Duy Viet to prepare a compensation file for Ms. Nhung with an area of 166 square meters, equivalent to 149.4 million VND.
On October 28, 2011, the District Compensation and Site Clearance Council held a meeting to report the results of the file assessment, stating that Mrs. Nhung's household did not have a land use origin, so it did not meet the conditions for compensation consideration. However, Mr. Nguyen Van Duc and Mr. Le Duy Viet stood up to analyze and propose that the Compensation and Site Clearance Council compensate Mrs. Nhung according to the established file. On that basis, Mr. Nguyen Hien Luong - Chairman of Nghi Xuan District People's Committee concluded that Mrs. Nhung's household agreed to approve but had to provide complete documents before being paid. To meet the above conditions according to Nguyen Van Duc's instructions, Mrs. Nhung went to Nguyen Cong Minh's house to ask him to write a receipt with the content "purchase of kindergarten and land allocation" with the amount of 70 million VND... On December 30, 2011, although Mrs. Nhung's household's file did not have enough legal basis, the accountant had not yet created a payment receipt, Mr. Le Duy Viet - the account holder still signed to approve the payment to Mrs. Nhung of 149.4 million VND. That shows that, although Mrs. Nhung's household did not have land, she colluded with some members of the BTGPMB Council to create fake documents to receive compensation and resettlement land.
Regarding the case of creating fake documents, BTGPMB of Ben Thuy 2 bridge project, on June 9, the Investigation Police Agency of Ha Tinh province prosecuted Le Quang Sang, Nguyen Van Duc, Dau Huu Tuat (54 years old, Head of Agriculture and Rural Development Department, former Head of Natural Resources and Environment Department, Vice Chairman of BTGPMB Council) for acts of "lack of responsibility causing serious consequences" and "intentionally violating State regulations on economic management causing serious consequences". At the same time, Phan Duy Khuong (43 years old, Chairman of Xuan An town People's Committee) was prosecuted for the act of "abusing position and power while performing official duties". Previously, in October 2013, the Nghi Xuan District Police Investigation Agency investigated violations in compiling compensation records, supporting land acquisition and resettlement, and granting resettlement land for the Ben Thuy 2 Bridge construction project. Thereby, the case was prosecuted, two defendants were prosecuted: Dau Huu Than (58 years old, living in residential group 5, former Chairman of Xuan An Town People's Committee from 1990 to 1999), Nguyen Van Hoa (39 years old, living in residential group 9, former cadastral officer of Xuan An Town from 2000 to April 2013) for the act of "fraudulent appropriation of property"... and transferred the case file to the Ha Tinh Provincial Police Investigation Agency to conduct an investigation according to its authority.
According to private sources, in the case of BTGPMB of Ben Thuy 2 Bridge Project, the amount of compensation and fake records amounted to billions of dong...
