Ms. Hoang Thi K. was eligible for a health insurance card. However, when she got married and left the locality, moving to another place but not registering with her husband's family, the local government where she registered her residence stopped issuing her a health insurance card.

Ms. K. is an ethnic minority, with permanent residence in Na Lech village, Luong Bang commune, Cho Don district, Bac Kan province (an area with particularly difficult socio-economic conditions). Ms. Kieu got married and lived in group 7, Song Cau, Bac Kan city, Bac Kan province, but did not move to her husband's house, she stayed home to raise her children.

In 2018, the People's Committee of the commune where she registered her permanent residence stopped issuing her health insurance card because she did not live in the locality. Ms. K. asked, is that right or wrong? Will she be granted health insurance?

On this matter, taccording to the provisions of Clause 4, Article 1 of the Law on Health InsuranceNo. 46/2014/QH13 amending and supplementing a number of articles of the Law on Health Insurance, Article 4 of Circular No. 25/2016/TT-BLDTBXH dated July 26, 2016 of the Ministry of Labor - Invalids and Social Affairs guiding, identifying and managing health insurance participants: "The People's Committee of the commune is responsible for making a list of health insurance participants who are ethnic minorities living in areas with especially difficult socio-economic conditions and sending it to the district-level Department of Labor - Invalids and Social Affairs to review and identify the correct subjects to be granted health insurance cards".

According to the provisions of Clause 7, Article 2 of Circular No. 25/2016/TT-BLDTBXH guiding the subjects participating in health insurance, the State pays and supports the health insurance premium level, which is "People living in areas with especially difficult socio-economic conditions according to the Prime Minister's Decision".

Therefore, Ms. Kieu no longer lives in Na Lech village, Luong Bang commune, Cho Don district, Bac Kan province, so the People's Committee of Luong Bang commune did not make a list to issue a health insurance card to her, which is correct according to regulations.
