Do not stop a vehicle in traffic to fine "vehicles without owner"

The Ministry of Public Security has just issued Circular No.11/2013/TT-BCAdetailing the implementation of a number of articles of the Decree34/2010/ND-CPand Decree71/2012/ND-CPon administrative sanctions for violations in the field of road traffic.

One of the notable contents of this Circular is the regulation on penalties for not transferring vehicle ownership as prescribed. The penalty for this act is stipulated in the Circular as follows:

Vehicles in traffic are not allowed to stop for inspection or handling of "non-transfer of vehicle ownership according to regulations".

Through registration, license plate issuance; investigation and settlement of traffic accidents, through technical equipment; cases of vehicles violating the regulations being temporarily detained according to regulations and through investigation of criminal cases, if it is discovered that the buyer or seller does not carry out procedures for transferring the name, moving, or changing the vehicle registration (buying or selling a vehicle without transferring the name) according to the regulations in the Circular of the Ministry of Public Security regulating vehicle registration, it is necessary to verify and clearly identify the violation: "buying or selling a vehicle without transferring the name" and impose a penalty in cases where the time limit of 30 days from the date of making the documents for buying or selling the vehicle has not yet been completed for transferring the name, moving, or changing the vehicle registration according to regulations.

According to Decree 34/2010/ND-CP and Decree 71/2012/ND-CP, the act of not transferring vehicle ownership as prescribed will be fined from 800,000 VND - 1.2 million VND for motorbikes and scooters; 6 - 10 million VND for cars.

Also according to the newly issued Circular 11/2013/TT-BCA, at the time of inspection, if the vehicle driver cannot present the Vehicle Registration Certificate; Driver's License; Driving License (or Certificate) and Certificate of Road Traffic Law Training; Certificate of Technical Safety and Environmental Protection Inspection, which the driver claims to have but does not carry, a record of administrative violation for the act of not having the required documents will be made; the vehicle will be temporarily detained according to regulations.

During the time limit for settlement, if the competent authority has not yet issued a decision on penalty, and the violator presents the required documents, the officer in charge of handling administrative violations must temporarily detain the documents, record on the back of the administrative violation record (saved copy) the time the documents were presented; sign and clearly state their full name; report to the competent authority to return the detained vehicle to the violator; and issue a decision on penalty for not carrying documents.

Circular 11/2013/TT-BCA will officially take effect from April 15, 2013.
