Discussing the legal issues when buying used cars and motorbikes, lawyer Nguyen Thu Trang, Hung Dao Thang Long Law Office, said that according to current law, within 30 days from the date of making the vehicle ownership transfer documents, the organization or individual who buys, is transferred, given, or gifted the vehicle must go to the vehicle registration agency to complete the procedures for registering the name change and moving the vehicle.

If the vehicle is not transferred to the owner's name, the motorbike owner (individual) may face a fine of VND 400,000 to VND 600,000 (Point a, Clause 4, Article 30, Decree 100/2019/ND-CP).

Car owners (individuals) can be fined from 2 million to 4 million VND (according to Point l Clause 7 Article 30 Decree 100/2019/ND-CP).

Lawyer Nguyen Thu Trang added that not only the new owner, but also the old owner of a car or motorbike may face legal risks if the ownership is not transferred to the owner's name.

According to Circular 24/2023/TT - BCA of the Ministry of Public Security, when buying and selling a vehicle without transferring the name, the identification number plate is still managed by the old owner. In case of an accident, the vehicle owner must bear legal responsibility for the vehicle attached to his identification number plate.

Thus, when a car or motorbike is involved in a traffic accident, a violation of the law, or a civil or criminal case, the previous owner, even if he or she did not violate or commit a crime, but because his or her name is on the vehicle registration, will be invited by the competent authority to work to verify, clarify, and resolve the case, case...

Therefore, when transferring or buying and selling vehicles, the seller and buyer need to transfer the ownership in accordance with regulations to avoid legal problems.
