How much is the fine for not transferring the vehicle name?

For the error of not transferring the vehicle's name, according to the provisions of Point a, Clause 4, Article 30, Decree 100/2019/ND-CP and Point l, Clause 7, Article 30, Decree 100/2019/ND-CP, the penalty for the act of "Not completing the vehicle registration procedure" is determined:

- For motorbikes: Individuals will be fined from 400,000 to 600,000 VND; organizations will be fined from 800,000 to 1.2 million VND.

- For cars: Individuals are fined from 2 million to 4 million VND; organizations are fined from 4 million to 8 million VND.

Article 6, Circular 24/2023/TT-BCA stipulates: When selling a vehicle (transferring vehicle ownership), the vehicle owner must retain the vehicle registration and license plate and return them to the vehicle registration authority for collection. In case the license plate is not returned to the vehicle registration authority, the vehicle owner will be fined.

In case the vehicle has been sold but not yet registered, the previous owner is still the name on the vehicle registration. If the vehicle is registered within 30 days (as prescribed), both the buyer and seller must complete the procedures to withdraw and register the vehicle.

However, if the vehicle registration has not been transferred within 30 days, according to Article 6, Circular 24/2023/TT-BCA, the previous owner of the vehicle will be fined, and then the vehicle registration transfer application will be processed.

According to Article 31, Circular 24/2023/TT-BCA, if the vehicle has had many owners, the vehicle registration authority will issue an administrative penalty decision for not carrying out the recall procedure first and then carrying out the name change procedure.

Therefore, the subject of administrative penalty when transferring the vehicle's ownership in this case, the previous owner of the vehicle is fined for "failing to comply with the revocation of vehicle registration and license plate". The fine for failing to revoke license plates and vehicle documents and not transferring the vehicle's ownership when selling the vehicle is based on Point e, Clause 5, Article 30 of Decree 100/2019/ND-CP, Point c, Clause 7, Article 30 of Decree 100/2019/ND-CP.

If the old owner has completed the repossession procedure but the new owner does not transfer the vehicle ownership, the new owner (the person receiving the vehicle ownership transfer) will be fined for "not completing the vehicle registration transfer procedure".
