The Director of the Department of Inspection of Legal Documents has proposed that the Ministry of Justice review the reasonableness and feasibility of the fine of 2-5 million VND for the act of listening to the phone at a gas station according to Decree 52, which took effect from August 5.

Dr. Le Hong Son - Director of the Department of Inspection of Legal Normative Documents (Ministry of Justice) - signed a document sent to the Minister of Justice requesting a review of the reasonableness and feasibility of the penalty regulations for the act of listening to the phone at a gas station stated in Decree 52 of the Government regulating the level of penalties for administrative violations in the field of fire prevention and fighting, effective from August 5.

Dr. Son said that since Decree 52 came into effect, public opinion and the media have reflected the fact that there is no timely punishment for the use of mobile phones at gas stations. Therefore, the head of the Department of Inspection of Legal Documents requested the Minister of Justice to organize research and consider timely recommendations to the Government on the reasonableness and feasibility of this regulation.

"Decree 52 clearly stipulates the acts, fines, and authority to fine, but information from public opinion shows that many violations have occurred but have not been detected and punished according to regulations," said Mr. Son.

The Director of the Department of Inspection of Legal Normative Documents requested the Minister of Justice to assign the Department of General Issues on Lawmaking to preside over research on the current status of law enforcement related to this content to promptly report and make recommendations to the Government.

It is known that the regulations on penalties for the act of listening to the phone at the gas station were stipulated in Decree 123/CP issued in 2005, but since then, almost no one has been punished. This Decree has been replaced by Decree 52, effective from August 5.

According to the new decree, the fine for using fire-generating or heat-generating devices and tools such as mobile phones, pagers, broadcasting devices, cameras, and cameras without explosion-proof devices in prohibited areas has been increased from 200,000-500,000 VND to 10 times higher than the old decree, to 2-5 million VND.


Although the fine has been increased 10 times, with the highest fine for using the phone in a prohibited area at a gas station being up to 5 million VND/violation, the feasibility of the fine is not higher because there is no force involved in the fine.
