According to the Secretary of the Nhan Cu village Party cell, before the Nam Mo Hydropower project was built, he was invited to the Commune People's Committee to sign the documents and receive 2 million VND in compensation and tree support. Regarding the land, Mr. Quy said he was not compensated because he did not have a red book (Certificate of land use rights). In 2013, the Nam Mo Hydropower project blocked the water for electricity generation and connected it to the national grid. After the hydropower plant blocked the electricity generation, the water level in the reservoir rose, the flow changed, causing landslides. The area outside the previously placed landmarks of the people was gradually "swallowed" over time; the Party cell and the Village Front Committee have sent petitions to the commune and district many times, but there has been no response.
According to people's feedback, in the process of implementing the marker planting and site clearance (GPMB) of the reservoir area of the Nam Mo Hydropower project in Nhan Cu village (Ta Ca, Ky Son), there were some shortcomings, significantly affecting the legitimate rights of local households.

When the hydropower project was implemented, in Nhan Cu village, 16 households were compensated for trees, 9 households were compensated for some auxiliary works, but the land was not compensated or supported. Meanwhile, the households all confirmed that they moved to Nhan Cu to live since the end of 1989 and have been living stably since then. When discussing this issue with Mr. Vu Va Cha - Chairman of Ta Ca Commune People's Committee, he said that land without a red book would not be compensated. Regarding the origin and time of land use of the above households, he replied that he did not know clearly and needed to discuss with some officials in the commune. According to Mr. Vi Van Tien, Vice Chairman of Ta Ca Commune People's Council, "The above households have lived there for more than 15 years, but I do not remember the specific time, around 1988 or 1989".
Talking with Mr. Mua No Xu, Vice Chairman of the People's Committee of Ky Son district, former Chairman of the Land Acquisition Council of Nam Mo Hydropower Project, he affirmed: Nhan Cu households have not been granted Land Use Rights Certificates, so they cannot be compensated or supported for land. It has always been like that.
In recent times, nearly 70 people in Nhan Cu village have had to live in a state of constant fear. The water level of Nam Mo Hydropower Reservoir has been rising continuously, and land, trees, and crops outside the markers previously set by the investor have now been flooded and eroded. Mr. Mua No Xu added that after receiving complaints from the people, the district People's Committee invited the investor to work, and they also made a commitment to the district that they would use their own money to support people affected by the landslides to relocate before the Lunar New Year 2014. However, that promise has not yet been fulfilled, while the 2015 rainy season has arrived...
