"Circumventing the law"
For a long time, according to state and local regulations, a subject enjoying certain preferential, preferential or support regimes must ensure certain necessary and sufficient conditions.
For example, to enjoy preferential land allocation under the form of valuation, one must be a relative of a recognized martyr or war invalid; if living in a city or town, one must have a permanent household registration and not yet own a house or land in the city; similarly, to receive compensation, resettlement or relocation support, one must be subject to land recovery and be living stably there...
However, there is a reality that, after the central or provincial government issues a preferential policy or investment project (which will certainly have compensation support), instead of worrying about doing business, accounting for the amount of land and money that the state supports to develop production and stabilize life, some people find ways to "circumvent the law" to enjoy more preferential support policies from the state. This is the reason why in Vinh city and town in our province, after the policy of land allocation in the form of valuation for meritorious people, the number of policy families in need of land allocation suddenly increased. Many people from having land and houses became homeless (transferring the name to someone else); there are policy subjects who do not regularly live in the city or town, which means they do not have a need for houses and land but still import them to the city to apply for incentives.
On the other hand, in some communes in Quy Chau and Quy Hop, as soon as the State announced the investment in the Ban Mong irrigation dam project, besides the majority of households worried about being relocated from their old residence, there were still a number of people who separated households for their children before they were married, hastily organized weddings for their children, built temporary houses to conduct inventories to receive compensation and support from the State later.
Currently, the state's regulations on import separation have become more open and easier (decentralized to the Commune Police). Therefore, in confirming to enjoy land incentives, Vinh City has set out quite strict conditions, only households that merge at the prescribed time can enjoy incentives; the government and competent agencies must be responsible for the confirmation results. Authorities at all levels should promptly rectify the situation, not allowing the above-mentioned "legal loopholes".
