Abuse of power, deputy head of department sentenced to 20 years in prison

(Baonghean.vn) - After nearly a week of deliberation, on the morning of July 7, the People's Court of Nghe An province sentenced Dang Nam Hai (born in 1979, residing in Trung Do ward, Vinh city) for the crimes of Abusing power and position to appropriate property and the crime of abusing trust to appropriate property. Because of Hai in this case, 3 of Hai's colleagues also had to go to jail.

According to the conclusion of the authorities, from April to October 2011, Hai was the deputy head of the personal department of the Vietnam Export Import Commercial Joint Stock Bank (Eximbank) Nghe An branch. Taking advantage of the lack of strict management of Eximbank, with the assigned functions and tasks, taking advantage of the negligence of his subordinates, Hai borrowed more than 12 billion VND from the bank for personal use.

On November 10, 2011, due to previous acquaintances, Hai borrowed nearly 1 billion VND from Ms. Tran Thi Kim Thoa (residing in Cua Nam ward, Vinh city), claiming that it was to reverse the bank deed, but in reality it was to pay off debts for loans outside the society and he was unable to pay back Ms. Thoa. With the above actions, Hai was prosecuted by the People's Procuracy for two crimes: abuse of power to appropriate property and abuse of trust to appropriate property.

In this case, out of respect for their superiors, Nguyen Tien Dung (born in 1982, residing in Anh Son town, Anh Son district) and Nguyen Tien Phuc (born in 1988, residing in Nghi Huong commune, Cua Lo town) created 8 fake files of 5 customers to borrow more than 5 billion VND from Eximbank for Hai. After Hai transferred to Vinh because he did not have money to pay off the amount of more than 5 billion VND, Hai asked Dung and Phuc to create more fake files to get money to pay off Hai's loans. With the above actions, Dung and Phuc were prosecuted for "intentionally violating state regulations on economic management, causing serious consequences".

Nguyen Van Quan (born in 1988, residing in Nghi Kim, Vinh city) is a new employee of Hai, a subordinate of Hai. Due to lack of management experience, Hai stole his password and Hai disbursed nearly 4 billion VND. Quan was prosecuted for "lack of responsibility causing serious consequences".

At court, Quan and Dung showed remorse. Hai, although he confessed after committing the crime, did not admit to the crime at the trial. However, the jury still had enough grounds to convict Hai. As for Phuc, while on bail awaiting trial, Phuc escaped and is wanted by the authorities.

After consideration, the panel sentenced Hai to 13 years in prison for “abuse of power to appropriate property” and 7 years in prison for “abuse of trust to appropriate property”, totaling 20 years in prison. At the same time, in terms of civil matters, Hai must compensate more than 10 billion VND to the bank and nearly 1 billion VND to Ms. Thoa - the amount Hai has not yet recovered. Phuc was sentenced to 3 years and 6 months in prison and Dung to 3 years in prison but with a suspended sentence for intentionally violating state regulations on economic management causing serious consequences. For the crime of lack of responsibility causing serious consequences, Quan was sentenced to 18 months in prison but with a suspended sentence.
