The State Budget Law was first passed by the National Assembly in 2002. However, through practical implementation, a number of new and inadequate issues have arisen. Therefore, in 2014, the National Assembly Standing Committee drafted an amendment to adjust and supplement it and submitted it for comments to the National Assembly. This draft amended State Budget Law includes 76 articles, including 5 general provisions and 12 detailed provisions. Commenting on the draft amended State Budget Law, Nghe An delegates requested clarification on the case where a province has not yet balanced its revenue and expenditure, when its budget revenue exceeds the regulations, how will it be entitled to use the excess? How is the lower-level budget decentralized? Many expenditures, especially large expenditures under target programs, are only added in the middle of the year, without a plan from the beginning of the year, making it difficult for the People's Council Budget Committee to clearly understand the source, making it difficult to appraise and often having to issue bonds, which can easily lead to budget deficits and increased public debt.

In addition to the above content, representatives of the Department of Planning and Investment, the Tax Department, the State Treasury... proposed to unify the budget plan, the budget finance plan with the medium-term period in public investment, one side should not be a 3-year plan but the other side is a 5-year plan; it is necessary to clarify the budget stabilization period for how many years; the prescribed reserve level (1-3%) is too broad; supplement the basis for issuing bonds; clarify the concepts of increased revenue and excess revenue, thereby having a usage mechanism; some regulations are included in the draft but not necessary; it is necessary to set a milestone for inspection; supplement and clarify the disbursements from the treasury for the state budget to match reality; the disbursement of the reserve fund in unexpected and urgent cases, but to be strict, it must be considered and decided by the Standing Committee of the National Assembly or the Standing Committee of the local People's Council...

Receiving the comments, Mr. Pham Van Tan - Head of the National Assembly Delegation of the province emphasized that the State Budget Law is a very important law related to revenue and expenditure and public investment; many ministries and branches are interested in developing it; the delegates must be truly dedicated and close to their professional activities so that their comments and suggestions will be realistic; for Nghe An, a province that has not yet balanced revenue and expenditure, the development of this Law is even more meaningful, both to ensure revenue and expenditure balance and to prevent public debt from increasing. The Head of the National Assembly Delegation assigned the Office of the Delegation to synthesize comments and suggestions, complete it and submit it to the National Assembly in the next session./.
