Seeking comments on the draft amendments to the Labor Code (amended).
(Baonghean.vn) -On the morning of February 28, in Vinh City, the National Assembly Delegation of Nghe An organized a conference to collect opinions on the amendments and supplements to the revised Labor Code. Attending the conference were representatives of relevant departments, agencies and representatives of employees and employers.
The Labor Code is a fairly complete law in this field, first promulgated in 1994, and has since been amended and supplemented several times. However, with the emergence of new labor legal relations that tend to be increasingly diverse and complex, the Labor Code has revealed a number of limitations and inadequacies. In order to promptly adjust and manage social relations in this field, the 13th National Assembly decided to amend the Labor Code. The draft amendment to the Labor Code submitted for comments includes 258 articles and 17 chapters.
Giving opinions on the draft revised Law, the representative of the Department of Labor, Invalids and Social Affairs proposed to shorten the probationary period for simple jobs to limit the situation where employers take advantage of this regulation to sign labor contracts and pay workers too low wages; agreeing with the plan to stipulate that the total number of overtime hours in a year should only be equal to 50% of the working time in a year; female workers who work overtime during maternity leave can negotiate with their employers to receive additional benefits and the maternity leave should be extended from 4 to 6 months...
Representatives of the Social Insurance, the Provincial Labor Federation and enterprises spoke to propose clarifying some concepts in resolving labor disputes; adjusting and combining some regulations in the draft to be appropriate; regulations on payment of one-time severance allowance should be more suitable to the social insurance fund's funding conditions; employees who actually work for 12 months in a year are entitled to leave with full salary; regulations on additional cases where employees request unpaid leave if there are legitimate reasons such as taking care of sick relatives; additional regulations on the right to discipline employers after notification but the employee is still absent.
In the immediate future, we should maintain the retirement age; regulate overtime for specific sectors such as defense and security; workers in restaurants; regulate wages for workers in new forms; legalize regulations on holidays and Tet because our country has little time for holidays and Tet; strictly prohibit gender discrimination in labor recruitment; the regulation of no probation for some seasonal occupations is not practical...
