On the morning of February 28, the Ministry of Natural Resources and Environment held a press conference on collecting public opinions on the Draft Law on Land (amended).

At the press conference, Mr. Le Thanh Khuyen - Deputy Director General of the General Department of Land Administration - Ministry of Natural Resources and Environment said that based on the results of summarizing the implementation of the 2003 Land Law and the viewpoints and orientations stated in Resolution 19-NQ-TW, the discussion opinions of National Assembly Deputies, relevant ministries and branches will revise and complete the Draft Land Law (amended) to organize public consultation.

Accordingly, the content of the Draft Law on Land (amended) submitted for public consultation includes 14 chapters and 206 articles. Compared to the 2003 Law on Land, this Draft Law has 7 more chapters and 60 articles (the 2003 Law on Land has 7 chapters and 146 articles).

In the Draft Law on Land (amended), the issue of land finance and land prices (Chapter 8) will have some new points such as: Supplementing regulations on the basis for calculating land use fees and land rents (Article 103), Regulations on financial obligations when changing land use purposes (Article 104); Supplementing cases of exemption and reduction of land use fees and land rents including: "Using land to implement housing and residential land policies for ethnic minorities in border areas and islands; Provincial People's Committees establish a Land Development Fund to advance capital to proactively create a "clean" land fund according to the land use plan.



Overview of the press conference

Regarding land prices, amend the regulations on principles of land valuation according to land use purposes at the time the State recovers land, allocates land, leases land, calculates the value of land use rights when equitizing State-owned enterprises and calculates other financial obligations according to the provisions of the Land Law. Adjacent land plots with similar natural, economic, social and infrastructure conditions, and the same purpose of use at the same time of valuation shall have the same price. At the same time, the Government shall specify the method of determining land prices suitable for each type of land.

The land price framework is established periodically every 5 years and will be announced on January 1 of the first year of the period. When land prices increase or decrease by 20% compared to the land price framework, land prices in border areas and the period of continuous increase or decrease is 180 days or more, the Government will adjust the land price framework.

At the same time, it regulates the development of land price lists and the application of land price lists issued by the Provincial People's Committee.

For agricultural land, the Draft also stipulates the direction to clarify the State's responsibility in protecting rice-growing land and limiting the conversion of rice-growing land to non-agricultural purposes.

Regarding land use auctions, the Draft also supplements regulations on the State's allocation and lease of land for land recovered by the State due to rearrangement and handling of working headquarters, public service establishments, production and business establishments whose assets attached to the land are State-owned...

Up to now, the Ministry of Natural Resources and Environment has received many comments from people and businesses, mainly on issues related to land allocation, land lease, land valuation, land recovery, compensation, and resettlement support when the State recovers land.
