Consulting people on amending the 1992 Constitution

We express our high agreement with the content of the "Draft Amendment to the 1992 Constitution", issued by the National Assembly, to collect public opinions.

Please allow me to contribute the following ideas:

Article 2 (Amendment and supplement to Article 2):State power is unified, with division of labor, coordination and control among State agencies in the exercise of legislative, executive and judicial powers.

Opinion that: In reality, the "coordination" between our state management agencies, here and there, still has overlaps. Sometimes 1, 2, 3 agencies handle an incident together. This "coordination" itself is not tight, because no agency accepts to be the "coordinator". (For example: "Food safety" currently, we see that the Ministry of Industry and Trade, the Ministry of Agriculture and Rural Development, the Ministry of Health, the Market Management Department... all coordinate, but now it is not easy to assign responsibility to any ministry).

Therefore, when consequences occur, no one is responsible. It should only be written: State power is unified, with division of labor among State agencies in the implementation of legislative, executive, and judicial powers.

Article 9 (Amendment and supplement to Article 9)

1. The Vietnam Fatherland Front is a socio-political organization, a voluntary union of political organizations, socio-political organizations, social organizations and representative individuals of classes, social strata, ethnic groups, religions and Vietnamese people residing abroad.

- The word "typical" should not be used, because the front is a place that gathers all classes of people, not only "typical individuals" can stand in the Front organization.

Article 54 (Amendment and supplement of Articles 15, 16, 19, 20, 21 and 25).

Section 2: All economic sectors are important components of the national economy, developing together in the long term, cooperating, being equal and competing according to the law.

There are two issues to discuss:

* The draft uses the word "important", which makes it easy to infer: Is there any economic component that is not important?

* “Long-term development together”…, so when the time comes, a certain economic component falls behind the production relationship, of course it will self-destruct. The word “long-term” should not be used.

Should only write: All economic sectors are components of the national economy, developing together, cooperating, being equal and competing according to the law.

Article 86 (Amendment and supplement to Article 99):“Without the consent of the National Assembly and during the time the National Assembly is not in session, without the consent of the National Assembly Standing Committee, National Assembly deputies cannot be arrested or prosecuted…”. People see that National Assembly deputies are also Vietnamese citizens, and must be equal before the law. “There is no forbidden zone for anyone, if they break the law.”
