Seeking opinions to amend the Resolution on voting and vote of confidence

(Baonghean.vn) -On the morning of May 9, in Vinh City, the National Assembly Delegation of Nghe An Province held a conference to collect comments on the draft Resolution on taking a vote of confidence and voting for people holding positions elected or approved by the National Assembly and People's Council (amended). Comrade Pham Van Tan - Member of the Provincial Party Committee, Head of the National Assembly Delegation of the province chaired the conference. Also attending were Comrade Nguyen Huu Lam - Member of the Standing Committee, Head of the Provincial Party Committee's Organization Committee, Head of the Provincial People's Council's Legal Committee, representatives of departments and branches.

According to Resolution No. 35/2012/QH13 of the National Assembly on taking a vote of confidence, at the 5th session, the National Assembly took a vote of confidence for 47 positions elected or approved by the National Assembly; similarly, the People's Councils of 63 provinces and cities took a vote of confidence for 907 people, the People's Councils at the district level took a vote of confidence for 6,664 people; the People's Councils at the commune level took a vote of confidence for 58,488 people. With 3 levels of confidence taken: high confidence, confidence and low confidence, in general, the vote of confidence has achieved the set goals and requirements, being an important step forward in the supervisory activities of the National Assembly and People's Councils.

However, this is the first time a vote of confidence has been organized, without precedent or experience, so there are still limitations and difficulties, and it has not covered all practical situations. Based on the assessment of the difficulties, the National Assembly Standing Committee discussed and agreed to report to the National Assembly to temporarily suspend the vote and conduct a vote of confidence and amend and supplement Resolution No. 35 regulating this issue. According to the draft Resolution on the vote of confidence, the revised vote of confidence drafted by the Drafting Committee and reviewed by the National Assembly, there are 19 articles, including 4 parts: regulations on the scope and subjects of the vote; time limit and time of the vote of confidence; the level of confidence assessment in the vote of confidence and a number of other issues.

At the conference, based on the options proposed in the draft Resolution, delegates gave their opinions on whether or not to expand the subjects for taking and voting for confidence in the heads of specialized agencies under the People's Committees at the provincial and district levels while narrowing the subjects and not taking a vote of confidence for those working in elected agencies. Regarding the voting period, some delegates agreed with the plan to take confidence annually or once a term, but there were also opinions that it should be taken twice a term, conducted at the beginning of the third year and the end of the fourth year of the term; the level of voting should be only 2 levels: "confidence" and "no confidence" instead of 3 levels as at present....

In addition, agreeing with the draft plan, delegates proposed to add the subjects to be taken and voted for confidence, namely the Chief Justice of the People's Court, the Chief Prosecutor of the People's Procuracy, and the Heads of departments and branches who are members and members of the People's Committee; clearly and specifically stipulate each subject who must be taken and voted for confidence; it should not be stipulated that "other positions" are quite general because guidance in this field is still very lacking. The legal consequences for the case where more than half to 2/3 of the total number of delegates vote for "low confidence" are to resign or the Standing Committee of the People's Council requests the Chairman of the People's Committee at the same level to consider, decide and report to the People's Council at the nearest session to carry out the dismissal procedure; it is recommended to take and vote twice per term; the assessment report of the person who is taken for a vote of confidence must follow a unified form, ensuring honesty, objectivity and taking legal responsibility for his/her report...

At the conference, there were also suggestions that the voting and taking of votes of confidence by the People's Councils at the provincial and district levels should be regulated by the Provincial and District People's Councils; the National Assembly should provide guidance; at the Provincial People's Council, the broader the range of subjects for taking votes of confidence, the better...

Concluding the meeting, Comrade Pham Van Tan said that despite the short time for preparation and collecting opinions, with a serious and responsible working spirit, the delegates contributed quality and focused comments to the draft Resolution.
