Law issued, waiting for guiding Decree?
Pharmacist Mai's pharmacy has been in operation for many years, but now her family has transferred the store to another pharmacist. Pharmacist Mai's pharmacy sign has been taken down, but the pharmacy has not been able to put up a new sign yet. Although the pharmacist has been doing the procedures to change the pharmacy name for several months now, it has not been licensed by the competent authority.
The reason is that there is no Decree guiding the implementation of changing the name from one pharmacy or pharmacist to another. Customers who are familiar with the pharmacy still come to buy medicine every day, but the pharmacy is forced to close because selling medicine will be punished by the inspector on the grounds that the new pharmacist has not yet been granted a license to operate the pharmacy.
The law regulating the renaming of pharmacies and pharmacists was issued on November 1, 2010, and has been in effect for more than 3 months. However, the law has been issued but is still waiting for the Decree and Circular for guidance, so the law is still "suspended".
A reality that has existed for many years is that documents with the same content but there are two or more related guiding documents causing overlap in implementation as well as confusion for agencies in directing implementation according to which document?, or the Law still "misses the battleground", only guiding "big projects", ignoring "small projects" while the process must follow small to large tasks.
For example, the overlap between the content of the regulations and the guiding documents for implementing the 2003 Population Ordinance has been interpreted differently. According to Article 10 of the 2003 Population Ordinance, each couple and individual has the right to decide on the time of giving birth, the number of children and the interval between births.
However, this issue has led many people to misunderstand that the State encourages having many children. Therefore, the birth rate and the third child birth rate have increased sharply in recent years, especially among cadres and party members. Therefore, immediately after the promulgation of the ordinance, it must be amended.
From that reality, it can be seen that resolving the above shortcomings and problems is an issue that needs to be studied by competent authorities and sectors before promulgating the Law.
