Level of expenditure for administrative procedure control activities
Nghe An Provincial People's Council resolved:
Article 1Scope of regulation and applicable subjects
1. Scope of regulation:
a) This Resolution stipulates the content and level of expenditure to ensure the implementation of administrative procedure control activities in the province.
b) This Resolution does not apply to:
- Administrative procedure control activities within each state administrative agency, between state administrative agencies with each other, not related to the settlement of administrative procedures for individuals and organizations;
- Activities of controlling administrative violation handling procedures; inspection procedures and administrative procedures containing state secrets.
2. Applicable subjects:
a) Department of Justice;
b) People's Committees at all levels and agencies and units under People's Committees at all levels when performing administrative procedure control activities.
Article 2.Expenditure content and level
1. Specific detailed content:
a) Update, publish, publicize, control the quality and maintain the national database on administrative procedures;
b) Expenses for giving opinions on administrative procedures prescribed in projects and draft legal documents;
c) Expenditures for independent review of regulations on administrative procedures;
d) Expenses for members to participate in meetings, seminars, and discussions to collect opinions on regulations on administrative procedures and plans to simplify administrative procedures (district and commune levels apply to meetings to approve plans to simplify administrative procedures)
d) Report on review and assessment results by topic, industry and field;
e) Annual and ad hoc reports on administrative procedure control; Receiving and handling feedback and recommendations on administrative regulations in the province;
g) Expenses to support officials and civil servants who are the focal points for controlling administrative procedures at departments, branches and localities: For departments, branches and districts: maximum support of no more than 2 people/unit; for communes: support of 01 person/unit.
2. Specific expenditure levels to ensure the implementation of administrative procedure control work (according to the appendix issued with this Resolution);
3. For other expenditure contents to ensure the control of administrative procedures in the province that are not specifically regulated in this Resolution, they shall be implemented in accordance with Circular No. 167/2012/TT-BTC dated October 10, 2012 of the Ministry of Finance regulating the preparation of estimates, management and use of funds for implementing administrative procedure control activities and current regulations.
Article 3.Funding sources
1. The budget for ensuring the implementation of administrative procedure control activities at agencies and units under which budget level shall be paid by that budget level and shall be included in the annual budget estimate of the agency or unit.
2. In addition to the funding guaranteed by the local budget, agencies and units are allowed to mobilize and use other legal resources to strengthen the implementation of administrative procedure control within their management scope.
Article 4.Implementing organization
Assign the Provincial People's Committee to implement this Resolution.
Article 5.Effective date
This Resolution was passed by the People's Council of Nghe An province, term XVI, 11th session on July 16, 2014 and takes effect 10 days after the date of passage.
