Improving the effectiveness of state management in notary activities in Nghe An

In Nghe An province, there are currently 40 notary organizations, distributed in 16 district-level units and 84 practicing notaries, including 2 State Notary Offices No. 1 and No. 2 with 5 notaries, 38 Notary Offices with 79 notaries.

During more than 8 years of implementing the Notary Law, the State management of notarization has always received timely attention and direction from the Party Committee and the Government, both creating conditions for notary offices to establish and operate and ensuring compliance with the law in State management.
The number of notaries and notary organizations has increased in both quantity and quality of service; the activities of notary offices have become increasingly professional, becoming an indispensable public service in social life, contributing significantly to the process of administrative reform and judicial reform.

However, the distribution of the network of notary organizations is uneven between districts, between urban and rural areas; some districts do not have any notary offices established (Que Phong, Quy Chau, Con Cuong, Tuong Duong, Ky Son); There are no regulations on exploiting, using, and sharing information on contracts, transactions, and information to prevent assets.
Regulations on conditions for establishing and registering notary offices are still general and difficult to implement; Regulations on notary offices not having capital contributors in Clause 1, Article 22 of the Notary Law, but in reality, some notary offices still operate under the shadow of investors and capital contributors, but there are still no strong enough solutions or sanctions to end this phenomenon.
In addition, there are also cases of notarization outside the headquarters that are not in accordance with regulations, suspended notarization, pending notarization; unfair competition; uneven quality of notary staff; and some notaries who violate professional ethics and are administratively sanctioned.

From 2016 to 2023, the competent authority has inspected, examined, resolved complaints and denunciations, and sanctioned 31 notary organizations, with a fine of VND 191,000,000; sanctioned 19 individuals who were notaries with a fine of VND 185,000,000; 02 notaries were subject to an additional sanction: temporary revocation of the right to use notary cards.
In order to strengthen and improve the effectiveness of state management in notary activities, meet the requirements of socializing notary activities, develop the notary profession in accordance with the orientation of the Notary Law, Resolution No. 172/NQ-CP and the socio-economic development situation of the province, the development and promulgation of the Project "Strengthening state management in notary activities in Nghe An province for the period 2024-2030" is an urgent requirement.
Strengthening the application of digital technology in notarization activities
At the meeting, delegates basically agreed with the content of the Draft Decision on promulgating the Project to strengthen state management in notary activities in Nghe An province for the period 2024-2030.
In addition, there are some additional comments and adjustments such as in the section on assignment of responsibilities, the representative of the Provincial Tax Department gave comments to adjust the comments.“"Inspecting, examining, and guiding the compliance with tax laws for notary organizations as prescribed" into "organizing the implementation of state budget collection work as prescribed by law" to cover more comprehensively. The representative of the Department of Finance suggested that we should expand the mobilization from socialized sources and other legal sources for notary activities.

Speaking on this content, Comrade Le Hong Vinh - Member of the Provincial Party Committee, Permanent Vice Chairman of the Provincial People's Committee affirmed that basically notary activities in Nghe An province meet the requirements. However, based on practical needs in the field of notarization, it is necessary to develop a project to overcome existing problems and difficulties and meet the requirements of digitalization in notarization activities.
He noted that the sector should advise on adjusting some contents related to some budget items; have specific solutions to overcome existing limitations, including adding solutions related to Project 06 on digital transformation to reduce administrative procedures for people; and mechanisms to encourage notary activities in mountainous districts where there are no notary organizations.
In addition, strengthen communication work, raise awareness and responsibility of Party committees, authorities and people about the position and role of notary activities in social life, contributing to limiting disputes, complaints and lawsuits in civil and economic relations.
Also on the morning of September 11, comrade Le Hong Vinh - Permanent Vice Chairman of the Provincial People's Committee chaired and gave opinions on the Draft Decision promulgating the Regulation on coordination in the management and enforcement of laws on administrative handling in Nghe An province.
The Regulation has 3 chapters and 17 articles to ensure timely, synchronous, close, unified and effective coordination between relevant agencies in deploying and implementing activities on law enforcement on handling administrative violations (VPHC) in the province.
The contents of coordination include: Building, perfecting laws and monitoring the enforcement of laws on handling administrative violations; propagating, disseminating and educating the law; training and fostering legal skills on handling administrative violations; inspecting and supervising the enforcement of laws on handling administrative violations. Receiving, considering, resolving and responding to feedback and recommendations; inspecting the enforcement of laws on handling administrative violations; Building, managing, exploiting and using the national database on handling administrative violations. Comrade Le Hong Vinh highly appreciated the preparation of the Department of Justice in advising on the development of the regulations. However, he noted that it is necessary to clarify the content and coordination responsibilities of relevant sectors; supplement the content of periodic inspections to handle violations... so that the regulations can be effective in practice.
