Improve the effectiveness of implementation and completion of the social insurance and health insurance legal system

Vietnam Social Security has just issued Official Dispatch No. 663/KH - Social Security on the Plan to monitor the implementation of laws in 2016 of the Industry.

The plan aims to monitor the implementation of the Social Insurance Law; review and evaluate the implementation of the Social Insurance and Health Insurance Law and related laws of units in the Industry, organizations and individuals participating in Social Insurance and Health Insurance, thereby proposing solutions to improve the effectiveness of law enforcement and perfect the Social Insurance and Health Insurance law system; promptly detect difficulties, obstacles, inadequacies and limitations in the implementation of the Social Insurance and Health Insurance Law, propose specific solutions to contribute to improving the effectiveness of the implementation of the Social Insurance and Health Insurance Law and propose amendments, supplements and perfection of legal provisions on monitoring the implementation of the law.

The plan requires full implementation of the contents of Decree No. 59/2012/ND-CP dated July 23, 2012 of the Government on monitoring the implementation of the law and closely following the tasks stated in Resolution No. 01/NQ-CP on the main tasks and solutions to direct the implementation of the socio-economic development plan and the State budget estimate for 2016. Ensure that the monitoring of the implementation of the law is carried out regularly, comprehensively, with a focus and key points associated with the functions, tasks and powers of the Social Insurance agency. Closely combine the work of law enforcement with the work of checking, reviewing documents and the work of disseminating and educating the law.

Regarding the implementation of the work of monitoring the implementation of the law, including the following contents: Developing documents guiding professional operations in accordance with the Law on Social Insurance, the Law on Health Insurance and documents guiding the implementation; Developing regulations on coordination between Vietnam Social Insurance and relevant ministries and branches. Organizing the dissemination of legal education on professional training related to the activities of the Industry. In particular, focusing on disseminating the Law on Social Insurance, the Law on Health Insurance (amended), documents guiding the implementation of electronic transaction decisions in the fields of social insurance, health insurance, unemployment insurance; other relevant legal documents. Regarding monitoring the implementation of laws by sector and field assigned for management, focus on the following contents:

For focus areas:Collection of social insurance, health insurance, unemployment insurance, focusing on developing participants; developing the network of social insurance and health insurance collection agents; handling of social insurance and health insurance arrears at employers; issuance of social insurance books, health insurance cards, fund investment management; settlement of social insurance policies, social insurance and unemployment insurance payments; payment of health insurance examination and treatment costs.

Implementation of regulations on administrative procedure control in the field of social insurance and health insurance; implementation of administrative procedure reform and the status of receiving dossiers and handling administrative procedures; reviewing documents issued by Vietnam Social Insurance; appraising draft documents guiding the entire industry. Implementation of the Law on Anti-Corruption; Law on Practicing Thrift and Combating Wastefulness.

Contents of law enforcement monitoring: Assess the situation of promulgation of legal documents in the field of social insurance, health insurance and related laws. In particular, assess the timeliness and completeness of legal regulations on social insurance, health insurance and other related legal documents; the consistency and synchronization of legal documents; the feasibility of legal documents. Assess the situation of ensuring conditions for law enforcement such as the suitability of functions and tasks of the legal organization and other units in the organizational structure of the Social Insurance agency; the level of human resource response for legal work at the central and local levels; the level of funding and material facilities to ensure law enforcement.

Assess the situation of legal compliance such as the situation of law implementation of units in the Industry and civil servants and public employees in performing their duties; the accuracy and consistency in drafting and developing guiding documents of Vietnam Social Security and their implementation in practice; the level of compliance with the law, organizations and individuals, especially compliance with the provisions of administrative procedures according to the provisions of the law and the Industry.

Checking the situation of law enforcement: Strengthening the inspection of the organization and implementation of legal documents and professional guidance documents of the Industry. Thereby, collecting information to assess the current situation of law enforcement and the situation of handling law violations; promptly detecting difficulties, obstacles and contradictions in legal documents and professional guidance documents of the Industry to make recommendations to competent agencies and individuals to amend, supplement or abolish documents to suit the reality. Units and individuals who are the subjects of inspection are responsible for implementing the requirements of the inspection agency according to the provisions of law.

Collecting and processing information on the situation of law enforcement: Based on the results of information collection, inspection, investigation and survey of the situation of law enforcement mentioned above, the units under the Vietnam Social Security and the Social Security of provinces and cities shall handle according to their authority or propose competent agencies and individuals to handle the results of monitoring the situation of law enforcement according to the following contents: Implementing measures to ensure accuracy and consistency in guiding the application of the law; Amending, supplementing and promulgating new legal documents; Timely organizing the implementation of legal documents that have come into effect; Professional units, according to their functions and tasks, assess the implementation of legal provisions related to their field of operation; Social Security of provinces and centrally-run cities shall organize and assign officers in charge of legal work at their units to monitor, synthesize and evaluate the situation of law enforcement at the Social Security of provinces and cities.
