Enhancing the role of supervision and social criticism of the Fatherland Front

In general, the Draft Constitutional Amendment this time has ensured the concretization of the Party's viewpoints in the Platform and Documents of the 11th Party Congress on amending the 1992 Constitution. The content of the amendments and supplements in the Draft Constitution has basically resolved the problems and shortcomings of practice arising in the process of summarizing the implementation of the 1992 Constitution; at the same time, the spirit of amending the Constitution this time also ensures and thoroughly grasps the Constitution as the fundamental law, the original law of the State, with long-term predictability and stability.
Regarding comments on each content in the Draft Constitutional Amendment:
First is the structure, nature and content: it is necessary to study the 1946 Constitution to implement it appropriately, and should amend and develop it according to the guidelines of the 1946 Constitution.
Commenting on Article 4 of the Draft Constitution, the majority of delegates agreed to continue affirming that the Communist Party of Vietnam is the vanguard of the working class, at the same time the vanguard of the working people and the entire Vietnamese nation, the loyal representative of the interests of the working class, the working people and the entire nation, taking Marxism-Leninism and Ho Chi Minh Thought as the ideological foundation, and is the leading force of the State and society.
However, it is necessary to clarify the issue of the Party leading the State and society to fully promote the Party's leadership and affirm that the Party's leadership is the leading factor determining the victory of the Vietnamese revolution. The Party must improve its political capacity, moral qualities and organizational capacity to be able to solve practical problems of the revolution. It is necessary to prevent and combat the risks and degradation of cadres and Party members and it is necessary to institutionalize the Party's leadership role in the revised Constitution. In addition, it is proposed to revise the second paragraph of Article 4 of the Draft as follows: The Party must be closely attached to the people, serve the people, be supervised by the people, and be responsible to the people for its policies and decisions.
In Article 9, the role of supervision and social criticism of the Vietnam Fatherland Front. Although the Draft Constitution as well as the 1992 Constitution have stipulated, in reality, the institutionalization and lack of mechanisms to ensure that some aspects, especially the supervision role, have not met the requirements. The issue of supervision and social criticism needs to be regulated more specifically and clearly by the Constitution, in the conditions that the Vietnamese political system is led by a single political organization, our Party. Strengthening political and spiritual consensus among the people can only be achieved on the basis of democratic practice. It is noted that Clause 3, Article 9 does not accurately reflect the position and role of the Vietnam Fatherland Front, easily creating a mechanism of asking and giving.
In Article 60, the Draft should add that agencies, organizations and individuals must practice thrift; prevent and combat waste and corruption in socio-economic activities and state management. On the other hand, the Draft does not fully demonstrate the supreme role of the National Assembly in constitution-making and legislation; and does not specify the rights of the National Assembly in supervising and directing the activities of the Government.
