Nghe An discusses solutions to improve the effectiveness of civil and administrative judgment enforcement in 2025
On the afternoon of December 4, the People's Committee of Nghe An province held an online conference to summarize the work of civil and administrative judgment enforcement (CJE) in 2024 and deploy the implementation of targets and tasks in 2025.
The conference was chaired by comrade Le Hong Vinh - Member of the Provincial Party Standing Committee, Permanent Vice Chairman of the Provincial People's Committee, Head of the Provincial Civil Judgment Enforcement Steering Committee.
In 2024, in the context of the increasing number of tasks and money to be executed, and the need to cut down on staff, the work of THADS and HC in the area will continue to receive the attention, leadership and drastic direction of the People's Committees at two levels.

As a result, the work of THADS and HC has achieved and exceeded 5/5 groups of assigned targets and tasks. Compared to 2023, the number of completed cases/345.3 billion VND is 1,692 more (accounting for 10.46% in terms of cases, 56.51% in terms of money). Of which, 125 cases/352.3 billion VND have been completed, reaching 27.47% in terms of cases and 37.77% in terms of money for credit and banking cases; 444 cases/33.4 billion VND have been resolved, reaching 67.27% in terms of cases/53.32% in terms of money on the total number of cases and money with conditions for execution in criminal cases of corruption, economics, etc.

Regarding administrative enforcement, in 2024, the THADS agencies in the province completed 8/11 administrative judgments; monitored 11/11 judgments with monitoring content.
In 2024, the General Department of THADS of Nghe An province proposed the Ministry of Justice to classify the Collective as having excellently completed its tasks.
At the conference, representatives of some localities and units also expressed their opinions, pointing out a number of limitations, shortcomings and problems that make the work of THADS and HC encounter many difficulties, significantly affecting the time and effort of State agencies, as well as the rights of the parties. In particular, the awareness of some localities and units is still limited, considering THADS and HC as the task of a few units, so there is a lack of attention and direction.

The enforcement of judgments in cases related to credit and banking cases is facing many difficulties and complications. The reason is that the actual status of mortgaged and secured assets is different between the records and the field; the actual value of the assets is much smaller than the security obligation; some assets of an assembled nature have been replaced with machinery and equipment (fishing boats); some vehicles, excavators, and diggers are hidden and cannot be traced by the judgment debtor and the person with the secured assets...
There are judgments that declare many assets as security for one obligation, making it difficult to handle and pay the enforcement money. Many subjects even oppose and obstruct, causing the enforcement of the judgment to be prolonged.

Regarding the enforcement of administrative judgments, because the subjects of enforcement are administrative decisions and administrative acts, the enforcement process, in addition to being regulated by the law on administrative judgment enforcement, must also be regulated by specialized state administrative management laws, leading to many cases with prolonged enforcement times.
Some units also recommended the need to strengthen facilities for the THADS sector, especially investing in building evidence warehouses to meet the requirements of performing tasks.
Speaking at the conclusion of the conference, comrade Le Hong Vinh - Member of the Provincial Party Standing Committee, Permanent Vice Chairman of the Provincial People's Committee, Head of the Provincial Steering Committee for Civil Judgment Enforcement acknowledged the results of civil judgment enforcement and administrative judgment enforcement that localities and units have achieved in 2024.

In 2025, comrade Le Hong Vinh suggested that relevant levels and sectors should continue to do a good job of state management of administrative procedures and administrative sanctions in the area. Strengthen the role and responsibility of local Party committees and authorities, the two-level administrative procedure steering committees and the close coordination of relevant sectors to ensure leadership, direction and strict and effective management of administrative procedures and administrative sanctions in the area.
The Enforcement Sector needs to continue reviewing, researching, and proposing to perfect the institutions on THADS, HC and related laws to resolve practical difficulties and shortcomings, focusing on consulting and contributing ideas to develop the draft Law on THADS (amended) to submit to the 15th National Assembly to ensure progress and quality.

Focus on directing and advising on perfecting the team of key leading civil servants in the entire provincial THADS System. Arrange, assign, and use civil servants based on the arrangement of organizational structure, job positions, and staffing associated with consolidating and improving the quality of the team of Enforcement Officers and civil servants performing THADS work according to regulations...

At the conference, 5 collectives and 5 individuals with outstanding achievements in the work of THADS and HC in 2024 were awarded Certificates of Merit by the Chairman of the Provincial People's Committee.
