Nghe An: Urging the handover of signed Certificates to land users

(Baonghean.vn) - The Provincial Land Registration Office has just issued a document urging the work of handing over signed Certificates to land users; at the same time, requesting the People's Committees of districts, cities and towns to evaluate the responsibilities of the branches of the District Land Registration Office.

On March 30, 2023, the Provincial Land Registration Office issued Document No. 612/VPĐK-ĐK&CGCN on reporting the situation of granting signed Certificates to land users to the People's Committees of districts, towns, and Vinh city; branches of the District-level Land Registration Office.

According to the Provincial Land Registration Office, implementing the provisions of the Land Law, in the recent past, the Department of Natural Resources and Environment has coordinated with the People's Committees of districts, the Land Registration Office, branches of the District Land Registration Office and the People's Committees of communes to accelerate the issuance of Certificates to people in accordance with the project of measuring, declaring, registering and issuing Certificates. Through inspection and monitoring, many Certificates have been issued in the province, but have not been given to people.

The Department of Natural Resources and Environment and the Provincial Land Registration Office have issued many documents urging the People's Committees of districts, towns, cities, and branches of the Land Registration Office to inspect, review, and issue signed Certificates to land users (Official Dispatch No. 3516/STNMT-QLDD dated June 25, 2018; No. 5258/STNMT-QLDD dated September 6, 2018; No. 5246/STNMT-QLDD dated September 6, 2018 and the Provincial Land Registration Office has Official Dispatch No. 2136/VPĐK-ĐK&CGCN dated November 26, 2021).

However, currently, many Certificates have been signed but not yet given to land users, and are still pending at the branches of the Land Registration Offices in the districts, causing resentment among the people and public opinion (Nghe An newspaper reported in Con Cuong district). Therefore, to ensure the legitimate rights and interests of land users and to remedy this situation; the Provincial Land Registration Office requests the branches of the Land Registration Office to report the results of the implementation of granting signed Certificates to people from April 17, 2020 to present.

Check, review, summarize the quantity and classify the signed Certificates that have not been handed over to local land users that are still in the branches and clarify the causes and responsibilities, including: Not yet organized to hand over the Certificates; Organized to hand over but the land users have not received the Certificates; Organized to hand over but the land users are not eligible to hand over the Certificates; Organized to hand over but the Certificates were issued incorrectly; Other cases.

From the above synthesis results, develop a specific plan on the progress and results of handing over the issued Certificates to land users; notify the People's Committee at the commune level, along with a list of people granted Certificates to organize a public announcement at the People's Committee at the commune, village, and hamlet levels for land users to come and receive the Certificates. In the case of a signed Certificate but not yet handed over to the land user because the land user has not received the Certificate according to the notice of the competent authority, after 90 days from the date of notification to the land user, the branch of the Land Registration Office shall confirm in section IV on page 3 of the Certificate "Certificate not yet handed over due to... (state the reason for not being able to hand over the Certificate due to disagreement with the information on the Certificate, not yet fulfilling financial obligations, no need to record debt...) and archive according to regulations. In the case of issuing an incorrect Certificate, coordinate with the People's Committee at the commune level to guide people to prepare a dossier to re-issue the Certificate according to regulations.

Implementation time is completed before April 15, 2023 and the report is sent to the Land Registration Office (file number sent via gmail:[email protected]) to synthesize reports for the Department of Natural Resources and Environment.

In addition, in Document No. 612/VPĐK-ĐK&CGCN, the Provincial Land Registration Office also requested the People's Committees of districts, cities and towns to give their opinions on 2 contents:

The first,Evaluate the coordination between the district-level Land Registration Office branch and the commune-level People's Committee in organizing the handover of signed Certificates to people from April 17, 2020 to present (organized or not organized; good or not good).

Monday,Assess the existing problems, limitations and shortcomings in the operations of the District Land Registration Office branches in the past and make recommendations and proposals (if any).

The Provincial Land Registration Office requests the People's Committees of districts, cities and towns to give their opinions before April 10, 2023.

On March 26, 2023, Nghe An electronic newspaper published an article "Around the issue of people's red books being "suspended" in Con Cuong”. This article informs that people in Lien Dinh village, Chi Khe commune, until the end of October 2022, were granted the Land Use Right Certificate issued by the competent authority since 2018; the People's Committee of Con Cuong district reminded and urged the Con Cuong district Land Registration Office branch because of the backlog of issued Land Use Right Certificates, affecting the rights of the people.

On March 20, 2023, Con Cuong District People's Committee issued Document No. 267/UBND-TNMT on strengthening the appraisal and granting of Land Use Right Certificates after surveying cadastral maps to people in the district.

Here, the People's Committee of Con Cuong district requested the Standing Committee of the District Party Committee and the Inspection Committee of the District Party Committee to study and inspect the Party Cell of the District Land Registration Office branch in the leadership and direction of the implementation of the tasks of receiving, appraising, handing over, archiving records, issued Land Use Right Certificates, and reissuing Land Use Right Certificates, especially the work of archiving, handing over records, and cases that are not eligible for granting Land Use Right Certificates at the branch of the Land Registration Office to clarify the responsibilities of collectives and individuals who caused the loss of records (if any), and at the same time, complete the handover work according to regulations.

On March 29, the Standing Committee of Con Cuong District Party Committee studied and considered the proposal of the District People's Committee in Document 267/UBND-TNMT and agreed to assign the District Party Committee's Inspection Committee to preside over and establish a working group to conduct an inspection of the branch Party Cell of the District Land Registration Office.
