Nghe An will issue regulations on extra teaching and learning: Notable new points

Nghe An Provincial People's Committee has completed collecting opinions to issue regulations on extra teaching and learning in the province. The draft proposes many new points, including the time frame for banning extra teaching, organizational principles, applicable subjects and cases where extra teaching is not allowed.

The subjects of application are tutors and learners; organizations and individuals organizing tutoring and learning; and organizations and individuals related to tutoring and learning activities in Nghe An province.

Proposing 5 principles on extra teaching and learning

Extra teaching and learning may only be organized when students (hereinafter referred to as students) have the need to take extra classes, voluntarily take extra classes, and have the consent of their parents or guardians (hereinafter referred to as parents). Schools, organizations, and individuals organizing extra teaching and learning may not use any form of coercion to force students to take extra classes.

The content of extra teaching and learning must not be contrary to the provisions of Vietnamese law, must not contain prejudices about ethnicity, religion, occupation, gender, or social status; must respect the personality and treat learners fairly. The content of teaching according to the school's educational plan must not be reduced to include extra teaching.

Extra teaching and learning must contribute to the development of students' qualities and abilities; not affect the organization and implementation of the school's educational program and the implementation of the teachers' subject programs. Individualize teaching and learning, create an environment and motivation to promote the talents, strengths, and creative aspirations of learners.

The duration, time, location and form of organization of extra teaching and learning must be suitable for the psychology and age of the students, ensuring their health; complying with legal regulations on working hours and overtime.

No extra teaching or learning is held on holidays as prescribed by the State, during the following times: before 07:00, from 11:30 to 13:30, from 17:00 to 19:00 and after 22:00, on all days of the week.

Comply with legal regulations on security, order, safety, environmental sanitation, and fire prevention in areas with extra classes.

3 In case of not being allowed to teach extra classes, organize extra classes

No extra classes are organized for primary school students, except in the following cases: art training, physical education, and life skills training.

Teachers who are teaching at schools are not allowed to teach extra classes outside of school for money from students that the teacher is assigned to teach by the school according to the school's educational plan.

Teachers in public schools are not allowed to participate in the management and operation of extra-curricular teaching but can participate in extra-curricular teaching.

Organizing extra teaching and learning in and out of school

Extra teaching and learning in schoolFees are not collected from students and are only for students who register for extra classes for each subject as follows: students whose final semester subject results are not satisfactory; students selected by the school to train excellent students; final year students who voluntarily register for entrance exam review and graduation exam review according to the school's educational plan.

The school organizes for students who fall under the above regulations to write applications to register for extra classes for each subject in each grade according to regulations.

Based on the number of registered students, the school develops a plan to organize extra classes for each subject in each grade.

The arrangement of classes, timetables and organization of extra teaching and learning must ensure the following requirements: extra classes are arranged by subject for each grade; each class has no more than 45 students; extra teaching hours are not arranged alternately with the timetable and extra teaching content is not taught in advance compared to teaching according to the subject program distribution in the school's education plan; each subject is organized for no more than 2 extra periods/week.

Plans for organizing extra teaching and learning are made public on the school's website or posted at the school.

The organization ofextra classes outside of school must register for business in accordance with the provisions of law; publicly announce on the electronic information portal or post at the place where the tutoring facility is located the subjects that are organized for tutoring; the duration of tutoring for each subject according to each grade level; the location, form, and time of organizing tutoring and learning; the list of tutors; the list of tutors and the tuition fees before enrolling students in tutoring and learning classes according to regulations; tutoring classes must have no more than 45 students.

Extracurricular tutors must ensure good moral qualities and professional competence appropriate to the subjects they teach. Organizations and individuals providing extra teaching and learning are encouraged to increase the use of project-based teaching methods, problem solving, and the application of artificial intelligence (AI) in teaching to promote students' initiative and creativity, contributing to the development of digital human resources.

Teachers who are teaching at schools and participate in extra-curricular teaching must report to the Principal or Director or head of the school about the subjects, location, form, and time of extra-curricular teaching according to regulations.

About qManagement and use of funds for organizing extra teaching and learning, the draft Regulation states:The funding for organizing extra teaching and learning in schools is from the annual state budget and other legal funding sources of the unit according to the provisions of law. The level of spending on extra teaching and learning (beyond standard hours) is stipulated in the annual internal spending regulations of the unit. The level of collecting extra teaching fees outside of school is agreed upon between the parents, the student and the extra teaching facility.

The collection, management and use of tuition fees shall comply with the provisions of the law on finance, budget, assets, accounting, taxes and other relevant regulations.
