The matter has been going on for a long time but has not yet been satisfactorily resolved.

Have extra land?

In the petition, Mr. Loc stated: In 2001, his family bought from Mr. Nguyen Huy Tung 2 adjacent plots of land at plots 43 and 44; map sheet 3 according to the planning of Nghi Trung Commune People's Committee. The area of ​​each plot of land is 5m long, 20m long, and the total area of ​​each plot of land is 100m2. The boundary of the 2 plots of land is bordered to the west by the village road, drainage ditch and part of the airspace; the west borders Mr. Le Van Sy's land. In 2004, Mr. Loc's family built a house, built a wall and settled down. In 2014, the Land Use Registration Office coordinated with the People's Committee of Quan Hanh Town to measure and notify his family of encroaching on Mr. Le Van Sy's land. They asked him to move plot 1 closer to the concrete ditch, but his family did not agree.

Through investigation, it is known that the 2 plots of land that Mr. Loc bought are among the 47 plots of land that Nghi Trung Commune People's Committee planned for the residential area Nam Duong Xa Doai and were approved by the Provincial People's Committee under Decision No. 4156 in 1996. On October 10, 2007, Nghi Loc District People's Committee approved the completion plan for this area. At the end of 2007, 3 hamlets of Nghi Trung Commune were merged into Quan Hanh Town. After the merger, all documents of this residential area were handed over by Nghi Trung Commune People's Committee to Quan Hanh Town People's Committee for management. Currently, this residential area belongs to Block 7, Quan Hanh Town. Currently, most of the households here have been granted Land Use Rights Certificates by Nghi Loc District People's Committee. For Mr. Loc's 2 plots of land, the purchase and sale procedures have been completed but to date, the Land Use Rights Certificates have not been granted.

After measuring, the People's Committee of Quan Hanh Town concluded that the current land use of Mr. Loc's family increased to 361.6 square meters, while the area he purchased was only 200 square meters. This shows that Mr. Loc's family encroached on 172.1 square meters in all four directions. Specifically, the West encroached 2.6 square meters; the North encroached 0.7 square meters; the East encroached 77.8 square meters and the South encroached 91 square meters. Mr. Loc did not agree with this announcement and said that in the West, the family encroached on the excess land of the State. But in the East, the family is using the correct boundary, the correct landmark, not encroaching on anyone's land. Speaking to reporters, Mr. Loc said that when he bought land from Mr. Nguyen Huy Tung (at that time, he was Vice Chairman of Nghi Trung Commune People's Committee and is currently Secretary of Quan Hanh Town Party Committee), the land handover confirmation paper dated November 20, 2001 stated that to the west there was a part of land left over in the shape of a flag and a canal corridor after measuring the entire route. The minutes were signed by Mr. Tung, Ms. Pham Thi Loan and confirmed by Mr. Nguyen Ba Son (village chief), Mr. Vo Van Hua, a cadastral officer of the commune. In the file extracted from the land plot diagram established by Nghi Trung Commune People's Committee on June 25, 2004, it was shown that to the west of the land plot there was a part of land left over but the specific area was not stated.

As the person who sold the land to Mr. Loc's family, Mr. Nguyen Huy Tung, Secretary of the Party Committee of Quan Hanh Town, also confirmed that for the land he sold to Mr. Loc, there was a surplus land to the west. But I don't know exactly how much land there was? Previously, I bought the land only on paper and later when I sold it to Mr. Loc, I only transferred it on paper? Explaining the signature in the land handover confirmation, Mr. Tung said that I only signed to confirm the transfer of the area according to the land use rights certificate. Mr. Nguyen Ba Son, former head of Hamlet 1, said: At that time, I was the one who directly measured and marked the land plot of Mr. Loc's family. I confirm that there was a surplus land to the west of the land plot and the area to the north was 3.4m; to the south was 2.5m. At that time, I told Mr. Loc that he could encroach on it, but when the State reclaimed it, he had to pay the State, and would not be compensated for the land.

Did Mr. Loc encroach on Mr. Sy's land?

Thus, according to some people's opinions, the West side of the land plot has extra land, but the exact area needs to be clarified. Regarding the fact that the People's Committee of Quan Hanh Town said that Mr. Loc is encroaching on Mr. Le Van Sy's 77.8 square meters, there is much conflicting information. According to the People's Committee of Quan Hanh Town, adjacent to Mr. Loc's land plot is lot number 3 of Mr. Le Van Sy; lot number 4 is of Mr. Le Van Thanh and lot number 5 is of Mr. Nguyen Ngoc Hong (now sold to Mr. Huong). However, Mr. Loc said: "My family built a wall based on the landmark that was placed by the commune and hamlet in 2001. Now, the landmark is still underground, I have requested the town to dig up and if there is a landmark, the ground must be restored, if there is no landmark, I will move to the West side but was not agreed. The town's handling of this is to legalize the insertion of a plot of land of Mr. Le Hoai Thanh into the currently vacant lot number 3.

According to Mr. Sy, in 2001, when Mr. Le Van Liem (father of Mr. Le Hoai Thanh) bought the land but had not yet been assigned the land. The Commune People's Committee then assigned him another location but he did not agree. The land that the District People's Committee has now granted to Mr. Thanh is exactly lot number 3, not lot number 4. This is the land that Mr. Dang Huu Duong sold to my family. In the land plot diagram, the family's land is lot number 3, the eastern boundary borders lot number 4 of Mr. Hong's family, the western boundary borders the land of Mr. Loc's family. Mr. Sy said: Recently, the Town People's Committee announced that my land is currently being encroached upon by Mr. Loc's family, but I confirm that there is no such incident. Because I am the one who planted the boundary stakes and built the fence for Mr. Loc's family. The wall was built exactly as the boundary was planted and is currently intact. I have repeatedly submitted requests to correct the boundary, the land plot is adjacent to Mr. Hong, not Mr. Liem, so that my family can have the right to use the land as before.

Mr. Ho Dai Duong, an officer of the Department of Natural Resources and Environment of Nghi Loc district, said: “In the completed land division map on Nam Xa Doai street on October 10, 2007, it shows that lot number 4 belongs to Mr. Le Van Thanh. In the map of the current land measurement, Mr. Loc's family is currently using 361.6 square meters, of which the western part of Mr. Loc's land has some extra land but the area is very small. Regarding the information that there was an omission during the land allocation period for Mr. Liem, so now the vacant lot next to Mr. Loc's land is inserted, Mr. Nguyen Xuan Thanh, Deputy Director of the Department of Natural Resources and Environment of the district, the person assigned to directly handle Mr. Loc's application, said: He has not yet grasped the matter. He will ask the Town People's Committee to report fully and will have a specific answer later.

According to the records as well as discussions with the representative of the district's Department of Natural Resources and Environment, the assertion that Mr. Loc's family encroached on Mr. Sy's family's land is not convincing. Moreover, the incident has lasted for many months, but the Nghi Loc District People's Committee has only invited Mr. Loc to work once on September 18, 2015, which is still slow. Mr. Loc, Mr. Sy and Mr. Thanh themselves are the ones who bought the land with full legal procedures and they have the right to be allocated land by the State. Therefore, in the coming time, to ensure the legitimate rights of the households, the District People's Committee needs to carefully study the records, record the opinions of the individuals involved to resolve the incident in a reasonable and sympathetic manner, avoiding the incident from being prolonged and causing instability in people's lives.
