What is the solution for the 'forgotten' prime land on Binh Minh Avenue?
The fact that next to Binh Minh Avenue, through Thu Thuy Ward (Vinh City), there is a vacant land for many years was reflected in the article "Forgetting" more than 2,000 square meters of prime land on Binh Minh Avenue by Nghe An Newspaper on August 22, 2024.
Waste of gold
In the article "Forgetting" more than 2000m2"Golden land on Binh Minh Avenue", reflects the current situation of the land between Maldives Hotel and Agribank's motel, along Binh Minh Avenue, in Thu Thuy Ward, Cua Lo Town (now Vinh City) is in a state of abandonment.
On the land there is only a row of level 4 houses with a system of yards, fences, degraded ancillary works and bushes, causing waste of land and affecting the urban coastal landscape.

Immediately after Nghe An Newspaper reported, Thu Thuy Ward People's Committee inspected and sent Report No. 50/BC-UBND to Cua Lo Town People's Committee. Accordingly, through the declaration of current status of land management and use of Nghi Loc District Nursing Home on July 1, 2008, the land was used since June 1996 with an area of 2,475m2.2According to Decision No. 1763/QD-UBND dated June 8, 1996 on land allocation for specialized purposes; the 2005 survey map and technical records show that the land plot has number 94, map sheet number 05 with an area of 2,230.9m2.2.
Regarding the current land use status, on the plot of land there is a row of 4-level houses with 5 rooms that have deteriorated; the property inside is old; the yard, fence, and outbuildings have also deteriorated; the tiled roof has completely buckled and collapsed; at both ends of the front yard of the row of houses, there are 2 temporary car garages; on the land area, trees and grass grow wildly.
On February 29, 2024, Thu Thuy Ward People's Committee issued Notice No. 06/TB-UBND on urban renovation to serve tourism in 2024 in the ward to Nghi Loc District People's Committee, however, the management unit of Nghi Loc District Nursing Home has not yet implemented the renovation.
Due to this situation, in Report No. 50/BC-UBND, Thu Thuy Ward People's Committee proposed: "To ensure environmental sanitation, urban landscape and avoid wasting land resources, we respectfully request Cua Lo Town People's Committee to work with Nghi Loc District People's Committee to find solutions to handle and resolve the issues that Nghe An Newspaper has reported."

Following the report of Thu Thuy Ward People's Committee, on the same day of August 22, 2024, Cua Lo Town People's Committee issued Document No. 1482/UBND-DT informing the current status of Nghi Loc District Retirement Home project to Nghi Loc District People's Committee and requested: "Arrange human resources and means to coordinate with Thu Thuy Ward People's Committee to carry out renovation and general environmental sanitation in the above land area. Study the plan to convert the investment model of the above project, in order to put the land into operation to ensure the beauty of the urban tourism area, while avoiding land waste".
On the side of Nghi Loc District People's Committee, upon receiving the information reported, it directed the functional departments to collect records and archives for inspection. Thereby, it was determined that in 1996, Nghi Loc District People's Committee was assigned by the province a land area of 2,475m2on Binh Minh Street, Cua Lo Town to implement the Nghi Loc District Retirement Home project. The project invested in building a number of small-scale works, put into use until the works were degraded and damaged in 2009.

Nghi Loc District People's Committee determined that the situation of land waste could not be prolonged, so it held a meeting to study management and usage plans in accordance with regulations.
Because this land is managed by Nghi Loc District People's Committee but the land location is in Cua Lo town; according to current law, Nghi Loc District People's Committee cannot continue to implement the Nursing Home project or establish a new project for investment, nor can it lease land, so the proposed plan is to report and propose to the Department of Finance and the Provincial People's Committee to consider and decide to implement according to Decree No. 167/ND-CP on regulations on arrangement and handling of public assets.
Speaking to Nghe An Newspaper reporter on September 13, 2024, Chairman of Nghi Loc District People's Committee, Mr. Nguyen Thanh Tung said: "I returned to Nghi Loc district to take up a new assignment for a short time, so I only got the information after the newspaper reported it.
Currently, in the district, there are also some public assets that need to be arranged and handled according to Decree No. 167/ND-CP. Therefore, Nghi Loc District People's Committee will review, synthesize, and report to the Department of Finance and the Provincial People's Committee for consideration and decision. We determine that this is a content that must be implemented soon, we cannot waste public assets, waste land...".
What is the solution for the golden land?
On December 6, 2024, Nghi Loc District People's Committee issued Document No. 3440/UBND-TCKH on the proposal to rearrange and handle houses and land in Nghi Loc district, phase 5, to the Department of Finance.
Here, Nghi Loc District People's Committee reported to the Department of Finance about organizing the review and submitting the auction plan for 2 real estate facilities; in which, 1 real estate facility is Nghi Loc District Resort and Nursing Home in Cua Lo Town (old).

The reason for choosing this option, according to Nghi Loc District People's Committee, is because: "The Nghi Loc District Rest House and Nursing Home was assigned land by the Provincial People's Committee in 1996 according to Decision No. 1763/QD/UB, in which Nghi Loc District People's Committee was assigned 2,475m2Urban land in Thu Thuy ward, Cua Lo town to build a retirement home.
However, since 2016, this facility has seriously degraded and is no longer in use. Nghi Loc District People's Committee proposed to auction it to generate revenue for the state budget, and create synchronous development for Cua Lo town.
Receiving Document No. 3440/UBND-TCKH of Nghi Loc District People's Committee, dated December 11, 2024, the Department of Finance coordinated with the Department of Construction and the Department of Natural Resources and Environment to inspect the current status of houses and land according to regulations. Based on the results of the current status inspection, based on current regulations, the Department of Finance issued Document No. 244/STC-QLG&CS dated January 20, 2025 to Nghi Loc District People's Committee with the following content:
“In Official Dispatch No. 3440/UBND-TCKH dated December 6, 2024, Nghi Loc District People's Committee proposed a plan to rearrange and handle 2 vacant houses and lands that are not in use by auction. However, Clause 3, Article 40 of the Law on Management and Use of Public Assets 2017, amended and supplemented in Clause 3, Article 5 of Law No. 56/2024/QH15 (effective from January 1, 2025), stipulates: “3. Sale. The form of sale is not applicable to public assets that are land and assets attached to land, except for land and assets attached to land of Vietnamese agencies abroad and cases that are sold according to other laws”.

At the same time, the Government has issued Decree No. 03/2025/ND-CP dated January 1, 2025 regulating the rearrangement and handling of public assets such as houses and land, effective from January 1, 2025, abolishing Decree No. 167/2017/ND-CP dated December 26, 2017 and Decree No. 67/2021/ND-CP dated July 15, 2021. In particular, Decree No. 03/2025/ND-CP specifically stipulates 5 forms of rearrangement and handling of houses and land, including: Retaining for continued use, recovery, transfer, transfer to local management, handling and temporary retention for continued use.
Therefore, we propose that the People's Committee of Nghi Loc district, based on the current regulations mentioned above, review and develop a plan to rearrange and handle housing and land facilities to ensure compliance with current regulations.
On February 4, 2025, Nghe An Newspaper reporters contacted and requested Nghi Loc District People's Committee to provide information on the plan to handle the real estate facility of the Resort cum Nursing Home. According to Mr. Nguyen Duc Tho - Vice Chairman of Nghi Loc District People's Committee, because receiving Document No. 244 / STC-QLG&CS of the Department of Finance close to the Lunar New Year 2025, Nghi Loc District will meet to discuss and choose a suitable handling plan in accordance with the provisions of law.
Mr. Nguyen Duc Tho added: "Nghi Loc district's viewpoint is to effectively use state assets, not allowing waste to occur...".
