How are employees paid for both working and sick leave?
The Ministry of Labor, War Invalids and Social Affairs recently issued Official Dispatch No. 4640/LĐTBXH-BHXH to respond to questions about the implementation of salary and social insurance regimes for employees.

Specifically, in the case where an employee has both time to work and time off to receive sick leave on the same day:
- During sick leave, the company does not have to pay the employee
- For the time the employee actually works, the enterprise must pay wages in accordance with the provisions of law.
Legal basis: Clause 2, Article 186 of the Labor Code stipulates: "During the time an employee is on leave and is entitled to social insurance benefits, the employer is not required to pay the employee's salary"./.
