Principles of valuation and price framework of land types to build the 2012 land price list

Pursuant to the Law on Organization of People's Councils and People's Committees dated November 26, 2003;


Pursuant to the 2003 Land Law;


Pursuant to the Government's Decrees: No. 188/2004/ND-CP dated November 16, 2004 on methods for determining land prices and price frames for land types; No. 123/2007/ND-CP dated July 27, 2007 on amending and supplementing a number of articles of Decree No. 188/2004/ND-CP; No. 69/2009/ND-CP dated August 13, 2009 on additional regulations on land use planning, land prices, land recovery, compensation, support and resettlement;


Pursuant to Joint Circular No. 02/2010/TTLT-BTNMT-BTC dated January 8, 2010 of the Ministry of Natural Resources and Environment - Ministry of Finance guiding the development, appraisal, promulgation of land price lists and adjustment of land price lists under the authority of the People's Committees of provinces and centrally run cities;


Considering the proposal of Nghe An Provincial People's Committee in Submission No. 6697/TTr-UBND dated November 7, 2011;


Based on the Audit Report of the Economic & Budget Committee and opinions of the Provincial People's Council delegates,


Resolution

Article 1.Land valuation principles


1. The price framework (maximum and minimum prices) prescribed for land types in the province must be within the price framework prescribed by the Government. The Provincial People's Committee has the right to adjust the price up to 20% higher than the maximum price and down to no more than 20% lower than the minimum price of the same type of land price framework prescribed by the Government.


For rural land along main traffic routes, traffic hubs, commercial and tourist areas, and industrial zones, the Government allows a maximum price increase of no more than 5 times the maximum price prescribed by the Government.


2. Price of non-agricultural production and business land:


Equal to 50% of the price of residential land with the same favorable conditions; for production and business land serving the purpose of mineral exploitation, it is equal to 300% of the price of residential land but not exceeding the maximum price of production and business land according to Government regulations.


Land for non-agricultural production and business along main traffic routes, traffic hubs, commercial and tourist areas, and industrial zones must not exceed 3 times the maximum price of land for non-agricultural production and business in rural areas according to Government regulations.


3. For residential land plots and non-agricultural land adjacent to at least 2 roads, the price is calculated according to the road with the higher price and takes into account the advantage of being adjacent to many roads.


4. For residential and non-agricultural land plots with a depth from the road construction boundary greater than 30m, the layering method shall be applied to determine the average price for the entire plot, but the price of the last layer of land must not be lower than the land price of adjacent plots with equivalent locations.


Article 2.Land price frame


1. Vinh City area (type I urban area):


a) Residential land: Maximum price 51,000,000 VND/m2, minimum price 550,000 VND/m2.


b) Agricultural land:


- Rice land:


Divided into 2 areas of communes and wards to determine prices:


+ In wards and plots of land in communes but bordering wards: apply a price of 100,000 VND/m2.


+ In the communes (except for plots bordering wards), there are 2 locations to determine the price: Maximum price (location 1) 85,000 VND/m2, minimum price (location 2) 75,000 VND/m2


- Land for annual crops:


Divided into 2 areas of communes and wards to determine prices:


+ In wards and plots of land in communes but bordering wards: apply a price of 100,000 VND/m2.


+ In the communes (except for plots bordering wards), there are 2 locations to determine the price: Maximum price (location 1) 85,000 VND/m2, minimum price (location 2) 75,000 VND/m2


- Aquaculture land:


Divided into 2 areas of communes and wards to determine prices:


+ In wards and plots of land in communes but bordering wards: apply a price of 100,000 VND/m2.


+ In the communes (except for plots bordering wards), there are 2 locations to determine the price: Maximum price (location 1) 85,000 VND/m2, minimum price (location 2) 75,000 VND/m2


- Land for perennial crops:


+ In wards: 100,000 VND/m2.


+ In communes: 85,000 VND/m2.


- Garden and pond land:


+ In wards: 100,000 VND/m2.


+ In communes: 85,000 VND/m2.


2. Cua Lo Town area (type III urban area)


a) Residential land: Maximum price 13,000,000 VND/m2, minimum price 400,000 VND/m2.


b) Agricultural land:


- Rice land:


Divided into 2 positions to determine price: (Position 1) 66,000 VND/m2, (Position 2) 62,000 VND/m2.


- Land for annual crops:


Divided into 2 positions to determine price: (Position 1) 66,000 VND/m2, (Position 2) 62,000 VND/m2.


- Aquaculture land:


Divided into 2 positions to determine price: (Position 1) 66,000 VND/m2, (Position 2) 62,000 VND/m2.


- Production forest land:


Divided into 1 location: land price 5,000 VND/m2


- Land for perennial crops:


Divided into 2 positions to determine price: (Position 1) 66,000 VND/m2, (Position 2) 62,000 VND/m2.


- Garden and pond land:


Apply according to the land price of location 1 of perennial land in the area but must be lower than the lowest residential land price in the area.


3. Thai Hoa town area (type IV urban area)


a) Residential land: Maximum price 10,000,000 VND/m2, minimum price 80,000 VND/m2.


b) Agricultural land:


- Rice land:


+ Divided into 4 positions to determine price.


+ For plain communes and wards: Maximum price (location 1) 62,000 VND/m2, minimum price (location 4) 43,000 VND/m2.


+ For low mountain communes and wards: Maximum price (location 1) 51,000 VND/m2, minimum price (location 4) 37,000 VND/m2.


- Land for annual crops:


+ Divided into 4 positions to determine price.


+ For plain communes and wards: Maximum price (location 1) 62,000 VND/m2, minimum price (location 4) 43,000 VND/m2.


+ For low mountain communes and wards: Maximum price (location 1) 51,000 VND/m2, minimum price (location 4) 37,000 VND/m2.


- Aquaculture land:


+ Divided into 4 positions to determine price.


+ For plain communes and wards: Maximum price (location 1) 62,000 VND/m2, minimum price (location 4) 43,000 VND/m2.


+ For low mountain communes and wards: Maximum price (location 1) 51,000 VND/m2, minimum price (location 4) 37,000 VND/m2.


- Production forest land:


+ Divided into 4 positions to determine price.


+ For plain communes and wards: Maximum price (location 1) 4,000 VND/m2, minimum price (location 4) 1,500 VND/m2.


+ For low mountain communes and wards: Maximum price (location 1) 3,500 VND/m2, minimum price (location 4) 800 VND/m2.


- Land for perennial crops:


+ Divided into 4 positions to determine price.


+ For plain communes and wards: Maximum price (location 1) 62,000 VND/m2, minimum price (location 4) 43,000 VND/m2.


+ For low mountain communes and wards: Maximum price (location 1) 51,000 VND/m2, minimum price (location 4) 37,000 VND/m2.


- Garden and pond land:


Apply according to the land price of location 1 of perennial land in the area but must be lower than the lowest residential land price in the area.


4. District locations


a) Land in towns (type V urban areas): Maximum price 8,000,000 VND/m2, minimum price 150,000 VND/m2.


b) Rural residential land:


- For plain communes: Maximum price: 7,000,000 VND/m2; Minimum price: 80,000 VND/m2.


For rural land along main traffic routes, traffic hubs, commercial areas, tourist areas, industrial parks, the maximum price is 7,000,000 VND/m2.


- For lowland communes (midlands): Maximum price: 5,000,000 VND/m2; Minimum price: 60,000 VND/m2.


For rural land along main traffic routes, traffic hubs, commercial areas, tourist areas, industrial parks, the maximum price is 5,000,000 VND/m2.


- For mountainous communes: Maximum price: 4,000,000 VND/m2; Minimum price: 30,000 VND/m2.


For rural land along main traffic routes, traffic hubs, commercial areas, tourist areas, industrial parks, the maximum price is 4,000,000 VND/m2.


c) Agricultural land:


- Rice land:


+ Plains and low mountain communes of Nghi Yen and Nghi Loc (because they are adjacent to industrial parks, tourist service areas of the province and along National Highway 1A):


Divided into 4 positions;


Land price: Maximum price (location 1) 58,000 VND/m2, minimum price (location 4) 28,000 VND/m2.


+ For lowland communes (midlands):


Divided into 4 positions;


Land price: Maximum price (location 1) 49,000 VND/m2, minimum price (location 4) 22,000 VND/m2.


+ For mountainous communes:


Divided into 4 positions;


Land price: Maximum price (location 1) 29,000 VND/m2, minimum price (location 4) 10,000 VND/m2.


- Land for annual crops:


+ Plains and low mountain communes of Nghi Yen and Nghi Loc (because they are adjacent to industrial parks, tourist service areas of the province and along National Highway 1A):


Divided into 4 positions;


Land price: Maximum price (location 1) 58,000 VND/m2, minimum price (location 4) 28,000 VND/m2.


+ For lowland communes (midlands):


Divided into 4 positions;


Land price: Maximum price (location 1) 49,000 VND/m2, minimum price (location 4) 22,000 VND/m2.


+ For mountainous communes:


Divided into 4 positions;

Land price: Maximum price (location 1) 29,000 VND/m2, minimum price (location 4) 9,000 VND/m2.


- Aquaculture land:


+ For the plain and low mountain communes of Nghi Yen and Nghi Loc (because they are adjacent to industrial parks, tourist service areas of the province and along National Highway 1A):


Divided into 4 positions;


Land price: Maximum price (location 1) 58,000 VND/m2, minimum price (location 4) 28,000 VND/m2.


+ For lowland communes (midlands):


Divided into 4 positions;


Land price: Maximum price (location 1) 49,000 VND/m2, minimum price (location 4) 17,000 VND/m2.


+ For mountainous communes:


Divided into 4 positions;


Land price: Maximum price (location 1) 29,000 VND/m2, minimum price (location 4) 7,000 VND/m2.


- Land for perennial crops:


+ For the plain and low mountain communes of Nghi Yen, Nghi Loc district (because they are adjacent to industrial parks, tourist service areas of the province and along National Highway 1A):


Divided into 4 positions;


Land price: Maximum price (location 1) 58,000 VND/m2, minimum price (location 4) 28,000 VND/m2.


+ For lowland communes (midlands):


Divided into 4 positions;

Land price: Maximum price (location 1) 49,000 VND/m2, minimum price (location 4) 18,000 VND/m2.


+ For mountainous communes:


Divided into 4 positions;

Land price: Maximum price (location 1) 29,000 VND/m2, minimum price (location 4) 8,000 VND/m2


- Production forest land:


+ For the plain and low mountain communes of Nghi Yen, Nghi Loc district (because they are adjacent to industrial parks, tourist service areas of the province and along National Highway 1A):


Divided into 4 positions;


Land price: Maximum price (location 1) 5,000 VND/m2, minimum price (location 4) 1,500 VND/m2.


+ For lowland communes (midlands):


Divided into 4 positions;


Land price: Maximum price (location 1) 4,500 VND/m2, minimum price (location 4) 800 VND/m2.


+ For mountainous communes:


Divided into 4 positions;


Land price: Maximum price (location 1) 4,000 VND/m2, minimum price (location 4) 500 VND/m2.


- Salt land:


+ Divided into 3 positions;


+ Land price: Maximum price (location 1) 40,000 VND/m2, minimum price (location 3) 30,000 VND/m2.


- Garden and pond land:


Apply according to the land price of location 1 of perennial land in the area but must be lower than the lowest residential land price in the area.


d) Other types of land:


Based on the land price framework to determine the price.


Article 3. Implementation


The Provincial People's Committee is assigned to base on this Resolution and Government regulations to issue the basis for classifying locations and detailed price lists of land types in the province within the prescribed time.


Article 4.Effective Date


This Resolution was passed by the 16th People's Council of Nghe An province, 3rd session on December 9, 2011 and takes effect 10 days after the date of passage.
