New policies effective from July 1

From July 1, many new policies take effect, in which the basic salary is adjusted to increase from 1.8 million to 2.34 million VND/month.

At the 7th session, the National Assembly passed a Resolution agreeing to salary reform with a plan to increase the basic salary from 1.8 to 2.34 million VND per month from July 1, 2024.

The National Assembly also agreed to increase the current pension and social insurance benefits by 15%. Those who received pensions before 1995, if after adjustment they receive less than 3.2 million VND/month, will have their pension adjusted to increase by 300,000 VND/month; those who receive from 3.2 million to under 3.5 million VND/month will have their pension adjusted to equal 3.5 million VND/month.

In addition, the preferential allowance for meritorious people at the standard level also increased by 35.7% from 2,055 to 2,789 million VND/month. The social assistance standard increased by 38.9%, from 360,000 to 500,000 VND/month; the regional minimum wage increased by an average of 6%, effective from July 1.

Add more security and order protection forces at the grassroots level

The force participating in protecting security and order at the grassroots level was established on the basis of unifying three forces, including: Civil Guard, part-time commune police who are still being used, and the captain and deputy captain of the civil defense team.

The force participating in protecting security and order at the grassroots level is a force established by local authorities on the basis of people's voluntariness to support the Commune, Ward and Town Police to help the People's Committees at the same level in protecting security and order and building a mass movement to protect national security.

Regarding standards and conditions to become a force participating in protecting security and order at the grassroots level, one must be a Vietnamese citizen from 18 to 70 years old, have a clear background, good moral qualities...

In case of over 70 years old and in good health, the Chairman of the People's Committee at the commune level shall consider and decide based on the proposal of the Commune-level Police.

The Ministry of Public Security has selected 12 localities as the launch locations for the force participating in protecting security and order at the grassroots level, including Lao Cai, Son La, Hai Duong, Nghe An, Quang Nam, Dak Lak, Khanh Hoa, Binh Duong, Ho Chi Minh City, Ba Ria - Vung Tau, Can Tho, and Ca Mau.

Citizen ID card becomes ID card

From July 1, the 2023 Law on Identification takes effect. Identification is basic information about a person's identity, background, identity and biometrics.

The issued citizen identification card is valid until the expiry date printed on the card. When needed, citizens can be issued a replacement ID card.

Identity cards that are still valid after December 31, 2024 will be valid until December 31, 2024.

Article 18 of the Law on Identification sets out the information fields shown on the Identification Card. These include facial photo; personal identification number; surname, middle name and given name; date of birth; gender; place of birth registration; nationality; place of residence; card issue date and expiry date.

Thus, compared to the 2014 Citizen Identification Law, the fields for information on hometown and fingerprints have been removed and do not need to be shown on the Identity Card.

People who are granted ID cards include: Vietnamese citizens from 14 years of age and older must carry out ID card issuance procedures; Vietnamese citizens under 14 years of age are granted ID cards upon request.

Transfers over 10 million must be authenticated by face

On December 18, 2023, the Governor of the State Bank issued Decision 2345 implementing safety and security solutions in online payments and bank card payments, effective from July 1, 2024.

Accordingly, from July 1, if money is transferred under 10 million VND and the total amount transferred during the day does not exceed 20 million VND, authentication is by OTP code, no need to authenticate by face or fingerprint.

If you transfer more than 10 million VND, facial and fingerprint authentication is required.

If the transfer amount is less than 10 million VND/transaction but the total transaction amount in the day has reached 20 million, the next transfer in that day must be authenticated by face or fingerprint, even if the next transfer is only a few thousand VND.

A husband cannot divorce his wife while she is pregnant, regardless of who she is pregnant with.

On May 16, the Supreme People's Court's Judicial Council issued a Resolution guiding the application of a number of legal provisions in resolving marriage and family cases. The Resolution takes effect from July 1.

Accordingly, Clause 4, 5, Article 2 of the Resolution stipulates: If the wife is pregnant or giving birth, the husband does not have the right to request a divorce regardless of who the wife is pregnant or giving birth to. If the wife is raising a child under 12 months old, the husband also does not have the right to request a divorce (regardless of whether it is a biological or adopted child).

Article 51 of the 2014 Law on Marriage and Family stipulates the right to request divorce as follows: The husband does not have the right to request divorce in case the wife is pregnant, giving birth or raising a child under 12 months old.

The law does not distinguish between a wife raising a child under 12 months old, whether it is her husband’s child or someone else’s child. Therefore, when the child is under 12 months old, regardless of whose child it is, the husband does not have the right to divorce.

Thus, not from July 1, but from before until now, the law (specifically the 2014 Law on Marriage and Family) has stipulated that the husband does not have the right to divorce when the wife is raising a child under 12 months old, regardless of whose child it is.

The issuance of the above Resolution by the Supreme People's Court's Council of Judges once again clarifies the husband's right to divorce when his wife is raising a child under 12 months old.
