(Baonghean) - Question: What are the specific regulations on subjects of land use fee collection?

Reply:According to Article 2, Decree 45/2014/ND-CP (Decree regulating land use fee collection) stipulates:

1. People who are allocated land by the State to use for the following purposes:

a) Households and individuals are allocated residential land;

b) Economic organizations are allocated land to carry out investment projects to build houses for sale or for sale combined with rent;

c) Vietnamese people residing abroad and foreign-invested enterprises are allocated land to carry out investment projects to build houses for sale or for sale combined with lease;

d) Economic organizations are assigned land to implement cemetery infrastructure investment projects to transfer land use rights associated with infrastructure (hereinafter referred to as cemetery land);

d) Economic organizations are allocated land to build mixed-use high-rise buildings, including residential areas for sale or for sale combined with rent.

2. People who are using land are permitted by the State to change the land use purpose to residential land or cemetery land in the following cases:

a) Agricultural land and non-agricultural land originally allocated without land use fees, now permitted by competent state agencies to be converted to residential land or cemetery land;

b) Agricultural land allocated by the State with land use fees collected, converted to residential land or cemetery land with land use fees collected;

c) Non-agricultural land (not residential land) with origin allocated by the State with land use fee collection converted to residential land with land use fee collection;

d) Agricultural land and non-agricultural land originally leased by the State and now converted to residential land or cemetery land at the same time as the conversion from land lease to land allocation with land use fee collection.

3. Households and individuals using land for housing or non-agricultural land recognized by the State for a long term before July 1, 2014, when being granted a Certificate of land use rights, house ownership rights and other assets attached to land, must fulfill financial obligations as prescribed in Articles 6, 7, 8 and 9 of this Decree.
