The pain of two women at the murder trial
Present at the murder trial were two women, the victim’s wife and the defendant’s mother, both sad and in pain. They were in pain because one had to endure the pain of losing her husband, while the other was tormented by the fact that her son had to pay the price of imprisonment for unjustly taking the life of his neighbor.

In the coastal commune of Son Hai, Quynh Luu district, the families of Nguyen Xuan Toi (born in 2004) and Thai Ba N. (born in 1954) are neighbors. In terms of age, Toi is Mr. N's descendant. In daily life, the two families often visit each other. The relationship between the two was good until the day Toi suddenly caused a shocking incident with Mr. N.
It was the afternoon of July 12, 2024, Toi and his neighbor went out to sit. At this time, Mr. N. was walking by so he stopped and talked to him for a few jokes. A moment later, Mr. N. left and the neighbor also went home so Toi was left alone.

About 10 minutes later, Toi saw Mr. N. walking down the street towards him. Thinking that Mr. N. was bothering him by walking back and forth in front of his house, Toi had the intention of beating him up.
Nguyen Xuan Toi took a round piece of wood and hit Mr. N many times. While hitting Toi, he said, “I’m sorry, sir.” When the victim collapsed to the ground, the young man continued to hit him many times on the head. Only when he heard the neighbors shouting did Toi stop, throw the piece of wood down and say, “Someone’s dead, surrender, go to the commune to confess.” Then, Toi raised his hands high and ran to the Son Hai Commune Police to confess.
As for the victim, Mr. Thai Ba N. died on the spot due to multiple consecutive blows to the head, causing severe brain damage. During the investigation, the police requested a forensic examination.mentalfor Nguyen Xuan Toi. The results showed that Toi suffered from post-concussion syndrome. Authorities determined that before, during and after the crime, Toi had limited cognitive ability and behavioral control.
According to Toi’s family, in 2020, this young man had a traffic accident, suffered a traumatic brain injury and had to be treated in hospitals. After being discharged from the hospital, Toi showed many signs of mental illness but his family did not have the means to take him for treatment.

The pain of two women
At the trial, the defendant admitted to the murder. When questioned by the jury about the motive for the crime, the defendant stated that because he saw the victim coming back many times, he thought that this person “had some intention” towards him so he wanted to beat him. Toi stated that at that time he did not think much, all he knew in his mind was that he had to beat this person, so he went to get a piece of wood, then aimed at the victim’s head and beat him.
The defendant admitted that he and the victim had never had any conflicts before. Before the defendant committed the crime, the victim had not caused any trouble. “I just saw Mr. N. walking back and forth in front of my house many times and thought he was about to do something, so I was scared,” the defendant stated.
Listening to the testimony of her husband’s killer, the victim’s wife shed tears many times. When the court allowed her to speak, she requested the panel of judges to strictly try the defendant according to the law.
This person stated that there was no conflict between her husband and the defendant Toi. However, Toi beat her husband to death on the spot for no reason. “My grandfather died in such a painful way, the pain is too great for the family,” the victim’s wife stated in court.
On the other side of the table, the defendant’s mother also bowed her head several times. She explained that her son had been in a traffic accident and suffered a traumatic brain injury, which left him mentally unstable. That time, after a period of treatment at the hospital, Toi showed signs of mental illness. However, due to circumstances, the family could not afford to take him for treatment and only took medicine at home.
“The mother bears the consequences of her son’s actions”, since the day her son caused the shocking incident, she and her husband have borrowed money to compensate the victim’s family 50 million VND for funeral expenses. On the days of the funeral, her family comes to burn incense to apologize to the deceased and offer condolences to the victim’s family. Although she knows the pain her son caused to the neighbor’s family is too great, she always hopes to receive sympathy and forgiveness from the victim’s family.
This woman confided that Toi had always been healthy. However, since the traffic accident, although the family had spent money and effort on treatment, the child's health condition was not very good. Helpless, they could only watch their child live with an unstable mentality. However, Toi committing murder was something they had never thought of. Therefore, at the trial, the defendant's family apologized to the victim's relatives.

The defendant also admitted his wrongdoings at the trial. He asked the jury to consider reducing his sentence so that he could soon return to start a new life and make amends with the deceased.
Considering the defendant’s actions as dangerous to society and having committed murder, the panel sentenced Nguyen Xuan Toi to 15 years in prison. Regarding the civil part, the court ordered the defendant to compensate the victim’s family 245 million VND, minus 50 million VND previously compensated.
The trial ended with a 15-year sentence for the murderer, but managing mentally ill subjects is a common lesson for many people. Because no one knows when these subjects will cause trouble to those around them.
