Mr. Huynh Van Nen was compensated 10 billion VND

After many negotiations, the People's Court of Binh Thuan province has decided to compensate Mr. Huynh Van Nen for wrongful conviction in the amount of 10 billion VND. If he does not agree, Mr. Nen still has the right to sue.

On the morning of March 7, at the People's Committee of Tan Minh town (Ham Tan district, Binh Thuan province), the People's Court of Binh Thuan province handed over a decision to resolve compensation for Mr. Huynh Van Nen, who was wrongly convicted in two murder cases that occurred in the locality.

Previously, on January 17, the People's Court of Binh Thuan province held a press conference to announce the successful negotiation results with Mr. Huynh Van Nen on compensation for wrongful convictions. Mr. Bien Van Hoan, Chief Justice of the People's Court of Binh Thuan province, said that in the seventh negotiation, the two sides agreed on a compensation amount of 10 billion VND.

Specifically, Mr. Nen was compensated nearly 5.3 billion for mental damage, 2.3 billion for health damage, nearly 1.2 billion for actual lost income and 1.2 billion for other damages.

Within 15 days from the date of receipt of the compensation decision, if he does not agree with this compensation settlement decision, Mr. Nen has the right to file a lawsuit requesting the Court to settle the compensation.

Lawyer Pham Cong Ut (Ho Chi Minh City Bar Association - who provided free legal support to Mr. Huynh Van Nen) said: according to regulations, after 15 days from receiving the compensation decision, if Mr. Nen does not have any complaints, he will receive the above compensation amount.

"This is the compensation amount that Mr. Nen and the People's Court of Binh Thuan province agreed upon after 7 negotiations, so Mr. Nen will not have any complaints!" - said lawyer Ut.

Regarding the handling of individuals and groups that violated the law, leading to the wrongful conviction of Mr. Huynh Van Nen, on January 9, 2017, the President decided to dismiss intermediate judge Nguyen Thanh Tam - the judge and presiding judge of the trial related to the murder case of Ms. Le Thi Bong in Binh Thuan in 1998, the case in which Mr. Huynh Van Nen was wrongfully convicted and imprisoned.

During the process of being prosecuted, Mr. Nguyen Thanh Tam was holding the position of Deputy Chief Justice of the Criminal Court of Binh Thuan Province. Therefore, on January 16, 2017, the People's Court of Binh Thuan Province issued a decision to dismiss him from the position of Deputy Chief Justice of the Criminal Court.

In addition, a judge who was a member of the 1998 trial panel was suspended from his duties as a judge for a period of one year, effective October 1, 2016.
