Prisoners will be able to participate in voluntary social insurance from January 1, 2020.

The 2019 Law on Enforcement of Criminal Judgments allows people sentenced to prison to enjoy social insurance regimes and policies.

According to the Law on Enforcement of Criminal Judgments 2019 effective from January 1, 2020, prisoners have the following rights:

- To have one's life, health, property protected, honor and dignity respected; to be allowed to send and receive letters, gifts, money; to read books, newspapers, listen to the radio, watch television in accordance with the conditions of the place of execution of the sentence.

- Participate in voluntary social insurance; enjoy social insurance policies and regimes according to the provisions of law.

- Use scriptures, express religious beliefs and faith according to the provisions of law.

- To conduct civil transactions by oneself or through a representative according to the provisions of law.

- Guaranteed right to complain and denounce; to request amnesty and compensation for damages according to the provisions of law.

Illiterate prisoners must study culture to overcome illiteracy. Prisoners are allowed to meet their relatives once a month, each meeting not exceeding one hour. Based on the results of the sentence execution classification, the prison decides to extend the time to meet relatives but not exceeding three hours or to meet their spouses in a private room for not exceeding 24 hours. Those who violate the rules are only allowed to meet relatives once every two months, each meeting not exceeding one hour.

The law provides that the following prisoners are to be held in separate detention:

- Prisoners who are homosexual, transgender, or of undetermined gender may be held separately.

- Prisoners with children under 36 months old following their mothers to prison.

- Prisoners who regularly violate rules

Female prisoners.

- Prisoners under 18 years old.

- Foreign prisoners.

- Prisoners with group A infectious diseases according to the provisions of the Law on Prevention and Control of Infectious Diseases.

- The prisoner shows signs of mental illness or other illness that causes loss of cognitive ability or ability to control his behavior while awaiting the Court's decision.

Based on the nature of the crime, the level of punishment, the personal characteristics of the prisoner, and the results of serving the sentence, the warden decides on the classification and transfer of detention areas.

Voluntary social insurance is a type of insurance organized by the State in which participants can choose the contribution level and payment method suitable to their income.

According to Clause 4, Article 2 of the Law on Social Insurance 2014, Vietnamese citizens aged 15 and over who are not subject to compulsory social insurance can participate in voluntary social insurance.

The voluntary social insurance contribution level is equal to 22% of the income level chosen by the individual. The lowest monthly income level used as the basis for contribution is equal to the poverty line for rural areas (700,000 VND) and the highest is equal to 20 times the basic salary (27,800,000 VND).
